2020 AN ACT ALLOWING STUDENTS AT INSTITUTIONS OF HIGHER
2121 EDUCATION TO LIVE OFF CAMPUS.
2222 Be it enacted by the Senate and House of Representatives in General
2323 Assembly convened:

2525 Section 1. (NEW) (Effective July 1, 2025) (a) As used in this section: 1
2626 (1) "Part-time student" means a student who is carrying not less than 2
2727 six but fewer than twelve credit hours in an academic semester; and 3
2828 (2) "Full-time student" means a student who is carrying twelve or 4
2929 more credit hours in a semester. 5
3030 (b) No institution of higher education in the state shall (1) prohibit 6
3131 any student enrolled at such institution who has completed not less than 7
3232 one academic year of postsecondary education, whether as a part-time 8
3333 or full-time student, from residing off campus, or (2) impose any 9
3434 restrictions, fees or other conditions on such student as a result of such 10
3535 student electing to reside off campus, except an institution of higher 11
3636 education may require such student to reside on campus if such student 12
3737 (A) receives a scholarship or grant that explicitly requires on-campus 13

4444 residence, (B) is under the age of eighteen, unless such student resides 14
4545 with a parent or legal guardian or is a legally emancipated minor, (C) 15
4646 enrolls in a specialized program or community that requires on-campus 16
4747 residence, including, but not limited to, a language immersion program 17
4848 or housing for honors students, or (D) is subject to any other 18
4949 circumstances requiring on-campus residence, as approved by the 19
5050 Commissioner of Higher Education. 20
5151 (c) For any enrolled student who is completing or has completed such 21
5252 student's first academic year of postsecondary education, each 22
5353 institution of higher education in the state shall (1) include in any notice 23
5454 to such student concerning housing options for any subsequent 24
5555 academic year the option for such student to reside off campus, and (2) 25
5656 provide, upon request, resources and guidance to such student for 26
5757 securing off-campus housing, including, but not limited to, information 27
5858 about local rental options and tenant rights. 28
5959 This act shall take effect as follows and shall amend the following
