AN ACT ALLOWING STUDENTS AT INSTITUTIONS OF HIGHER 
EDUCATION TO LIVE OFF CAMPUS. 
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. (NEW) (Effective July 1, 2025) (a) As used in this section: 1 
(1) "Part-time student" means a student who is carrying not less than 2 
six but fewer than twelve credit hours in an academic semester; and 3 
(2) "Full-time student" means a student who is carrying twelve or 4 
more credit hours in a semester. 5 
(b) No institution of higher education in the state shall (1) prohibit 6 
any student enrolled at such institution who has completed not less than 7 
one academic year of postsecondary education, whether as a part-time 8 
or full-time student, from residing off campus, or (2) impose any 9 
restrictions, fees or other conditions on such student as a result of such 10 
student electing to reside off campus, except an institution of higher 11 
education may require such student to reside on campus if such student 12 
(A) receives a scholarship or grant that explicitly requires on-campus 13

residence, (B) is under the age of eighteen, unless such student resides 14 
with a parent or legal guardian or is a legally emancipated minor, (C) 15 
enrolls in a specialized program or community that requires on-campus 16 
residence, including, but not limited to, a language immersion program 17 
or housing for honors students, or (D) is subject to any other 18 
circumstances requiring on-campus residence, as approved by the 19 
Commissioner of Higher Education. 20 
(c) For any enrolled student who is completing or has completed such 21 
student's first academic year of postsecondary education, each 22 
institution of higher education in the state shall (1) include in any notice 23 
to such student concerning housing options for any subsequent 24 
academic year the option for such student to reside off campus, and (2) 25 
provide, upon request, resources and guidance to such student for 26 
securing off-campus housing, including, but not limited to, information 27 
about local rental options and tenant rights. 28 
This act shall take effect as follows and shall amend the following 
sections: 
 
Section 1 July 1, 2025 New section 
 
Statement of Purpose:   
To require institutions of higher education to allow students to live off 
campus during any academic year after the first academic year in which 
a student is enrolled at such institution.
