ENGROSSED ORIGINAL 1 A BILL 1 2 25-306 3 4 IN THE COUNCIL OF THE DISTRICT OF COLUMBIA 5 6 ______________________ 7 8 9 To amend, on a temporary basis, section 23-581(a)(3) of the District of Columbia Official Code 10 to make a technical correction to clarify that a law enforcement officer may arrest, 11 without a warrant having been previously issued, a person that the officer has probable 12 cause to believe has committed the offense of fleeing from the scene of an accident, if the 13 officer has reasonable grounds to believe that, unless the person is immediately arrested, 14 reliable evidence of alcohol or drug use may become unavailable or the person may cause 15 personally injury or property damage. 16 17 BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 18 act may be cited as the “Law Enforcement Arrest Authority Technical Correction Temporary 19 Amendment Act of 2023”. 20 Sec. 2. Section 23-581(a)(3) of the District of Columbia Official Code is amended as 21 follows: 22 (1) Strike the phrase “Fleeing from the scene of an accident” and insert the phrase 23 “Leaving after colliding” in its place. 24 (2) Strike the phrase “section 10(a) (D.C. Official Code § 50-2201.05(a))” and 25 insert the phrase “section 10c (D.C. Official Code § 50-2201.05c)” in its place. 26 Sec. 3. Fiscal impact statement. 27 28 ENGROSSED ORIGINAL 2 The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact 29 statement required by section 4a of the General Legislative Procedures Act of 1975, approved 30 October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a). 31 Sec. 4. Effective date. 32 (a) This act shall take effect following approval by the Mayor (or in the event of veto by 33 the Mayor, action by the Council to override the veto), a 60-day period of Congressional review 34 as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 35 24, 1973 (87 Stat. 813, D.C. Official Code § 1-206.02(c)(1)), and publication in the District of 36 Columbia Register. 37 (b) This act shall expire after 225 days of its having taken effect. 38
