16-To amend, on a temporary basis, section 23-581(a)(3) of the District of Columbia Official Code
17-to make a technical correction to clarify that a law enforcement officer may arrest,
18-without a warrant having been previously issued, a person that the officer has probable
19-cause to believe has committed the offense of fleeing from the scene of an accident, if the
20-officer has reasonable grounds to believe that, unless the person is immediately arrested,
21-reliable evidence of alcohol or drug use may become unavailable or the person may cause
22-personally injury or property damage.

24- BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
25-act may be cited as the “Law Enforcement Arrest Authority Technical Correction Temporary
26-Amendment Act of 2023”.

28-Sec. 2. Section 23-581(a)(3) of the District of Columbia Official Code is amended as
29-follows:
30-(1) Strike the phrase “Fleeing from the scene of an accident” and insert the phrase
31-“Leaving after colliding” in its place.
32-(2) Strike the phrase “section 10(a) (D.C. Official Code § 50-2201.05(a))” and
33-insert the phrase “section 10c (D.C. Official Code § 50-2201.05c)” in its place.

35-Sec. 3. Fiscal impact statement.
36-The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact
37-statement required by section 4a of the General Legislative Procedures Act of 1975, approved
38-October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

40-Sec. 4. Effective date.
41-(a) This act shall take effect following approval by the Mayor (or in the event of veto by
42-the Mayor, action by the Council to override the veto), a 60-day period of congressional review
