17-To amend, on an emergency basis, the Comprehensive Policing and Justice Reform Amendment
18-Act of 2022 to clarify when law enforcement officers have authority to engage in a
19-vehicular pursuit of a suspect motor vehicle.

21- BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
22-act may be cited as the “Law Enforcement Vehicular Pursuit Clarification Emergency
23-Amendment Act of 2023”.

25-Sec. 2. Section 128(a) of the Comprehensive Policing and Justice Reform Amendment
26-Act of 2022, effective April 21, 2023 (D.C. Law 24-345; D.C. Official Code § 5-365.02(a)), is
27-amended as follows:
28-(a) Paragraph (1)(B) is amended by striking the phrase “immediate threat” and inserting
29-the phrase “imminent threat” in its place.
30-(b) Paragraph (2) is amended as follows:
31-(1) Subparagraph (A) is amended by striking the phrase “fleeing suspect,” and
32-inserting the phrase “fleeing suspect or suspects,” in its place.
33-(2) Subparagraph (B) is amended to read as follows
34-“(B) Under the totality of the circumstances, not likely to cause death or
35-serious bodily injury to any person, other than to the fleeing suspect or suspects; and”.

37- Sec. 3. Fiscal impact statement.
38-The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact
39-statement required by section 4a of the General Legislative Procedures Act of 1975, approved
40-October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

42-Sec. 4. Effective date.
43-This act shall take effect following approval by the Mayor (or in the event of veto by the
44-Mayor, action by the Council to override the veto), and shall remain in effect for no longer than
45-90 days, as provided for emergency acts of the Council of the District of Columbia in section
