15-To amend the Freedom of Information Act of 1976 to exempt from disclosure critical
16-infrastructure information or plans that contain critical infrastructure information for the
17-critical infrastructures of the District of Columbia Water and Sewer Authority.

19- BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
20-act may be cited as the “DC Water Critical Infrastructure Freedom of Information Clarification
21-Amendment Act of 2024”.

23-Sec. 2. The Freedom of Information Act of 1976, effective March 29, 1977 (D.C. Law 1-
24-96; D.C. Official Code § 2-531 et seq.), is amended as follows:
25-(a) Section 204(a)(15) (D.C. Official Code § 2-534(a)(15)) is amended by striking the
26-phrase “infrastructures of companies” and inserting the phrase “infrastructures of the District of
27-Columbia Water and Sewer Authority or companies” in its place.
28-(b) Section 209(b)(2) (D.C. Official Code § 2–539(b)(2)) is amended by striking the
29-phrase “infrastructure of companies” and inserting the phrase “infrastructure of the District of
30-Columbia Water and Sewer Authority or companies” in its place.

32-Sec. 3. Fiscal impact statement.
33- The Council adopts the fiscal impact statement in the committee report as the fiscal
34-impact statement required by section 4a of the General Legislative Procedures Act of 1975,
35-approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

37- Sec. 4. Effective date.
38- This act shall take effect following approval by the Mayor (or in the event of veto by the
39-Mayor, action by the Council to override the veto) and a 30-day period of congressional review as
