ENROLLED ORIGINAL A RESOLUTION 25-80 IN THE COUNCIL OF THE DISTRICT OF COLUMBIA March 7, 2023 To declare the existence of an emergency with respect to the need to provide for comprehensive policing and justice reform for District residents and visitors, and for other purposes. RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited as the “Comprehensive Policing and Justice Reform Emergency Declaration Resolution of 2023”. Sec. 2. (a) On April 5, 2022, the Council passed the Comprehensive Policing and Justice Reform Emergency Amendment Act of 2022, effective April 7, 2022 (D.C. Act 24- 370; 69 DCR 3370) (“emergency act”). The emergency act expired on July 6, 2022. (b) On April 19, 2022, the Council passed the Comprehensive Policing and Justice Reform Temporary Amendment Act of 2022, effective August 12, 2022 (D.C. Law 24- 149; 69 DCR 11395) (“temporary law”). The temporary law is set to expire on March 25, 2023. (c) The Comprehensive Policing and Justice Reform Amendment Act of 2022, enacted on January 19, 2023 ( D.C. Act 24-781; 70 DCR 953) (“permanent legislation”) makes, with some modifications, the provisions of the emergency act and temporary law permanent. The projected law date for the permanent legislation is May 11, 2023. (d) This final round of emergency and temporary legislation is now necessary to prevent a gap in the law between the expiration of the temporary law and the effective date of the permanent legislation. Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute emergency circumstances making it necessary that the Comprehensive Policing and Justice Reform Emergency Amendment Act of 2023 be adopted after a single reading. Sec. 4. This resolution shall take effect immediately.
