Dear Chairman Mendelson: 
In accordance with the provisions of D.C. Official Code §1-617.15(a), I am forwarding to you the 
following Collective Bargaining Agreement (CBA) for introduction and approval by the Council of the 
District of Columbia. The resolution is as follows: 
“Collective Bargaining Agreement between the University of the District of Columbia and the Service 
Employees International Union (SEIU) Local 500, CtW Approval Resolution of 2023
” 
The proposed collective bargaining agreement would cover compensation and terms and conditions of 
employment for members of the bargaining unit for the period October 1, 2022, through September 30, 
2025. The CBA does not 
include any retroactive salary adjustments for AY 2022-2023. Funds would be 
sourced from the university’s operating budget. 
Considering the significance of this action to our SEIU employees, I respectfully request that the 
Council submit the “Collective Bargaining Agreement between the University of the District of 
Columbia and the Service Employees International Union (SEIU) Local 500, CtW Approval 
Resolution of 2023
” for approval.

TheBoardofTrustees(“Board”)oftheUniversityoftheDistrictofColumbiapassedResolution
No,2023-48onNovember7,2023whichprovidedapprovalofaCollectiveBargaining
Agreement(CBA)betweentheUniversityandSEIUemployeeswhichincludesaone-timelump
sumpaymentof$1,000.00foradjunctfacultymemberswhoteachinanysemesterorsummer
termofAY2023-2024(August2023toAugust2024)andathreepercent(3.0%)increasein
basesalariesfortheUniversity’sSEIUemployeesforAY2024-2025(August2024toAugust
2025).
‘TheSEIUAgreementcoverscompensationandtermsandconditionofemploymentformembers
ofthebargainingunitfortheperiodOctober1,2022throughSeptember30,2025.TheCBA
doesnotincludeanyretroactivesalaryadjustmentsforAY2022-2023.
FinancialImpact:
TheUniversityhassufficientbudgetinoperatingfundsinFY24topayforthelumpsum
paymentsforSEIUemployees.TheUniversityhasalsoreservedsufficientbudgetinoperating
fundsinitsexistingbasebudgetanditsFY25budgetrequesttopayforthecostincreaseofthe
3%COLAinFY25,subjecttofutureappropriation.

(SEIU)adjunctfacultymembersemployedbytheUniversity.However,additionaladjunct
facultymembersnotcurrentlyonUniversitypayrollmaybecomeeligibleforthelumpsum
paymentiftheyteachinafuturesemesterorsummertermofAY2023-2024.
BasedonAY2022-2023adjunctfacultyappointmentsandcompensation,itisprojectedthat
therewillbe299SEIUadjunctfacultymemberseligibleforthelumpsumpaymentinFY24for
teachinginanysemesterorterminAY2023-2024andtheprojectedcostincreaseofthe3%
COLAinFY25isprojectedtobe$94,713,inclusiveofsalariesandfringebenefits(forecastedat
7.65%forSocialSecurityandMedicarepayrolltaxes).
TheCBAapprovedbytheresolutionalsoincludesincreasesinCourseCancellationFeesfrom
$350to$400andCourseDevelopmentFeesfrom$1,000to$1,500,ascomparedtotheprevious
CBAbetweentheUniversityandSEIUemployees.Theprojectedfiscalimpactofthose
provisionsis$17,224annually.

WHEREAS,SEIUmembershipratifiedtheCBAinNovember2023;and
WHEREAS,theBoardofTrusteeshasreviewedtheproposedagreementandconsidersthatit
representsafairandreasonableresolutionofbothbargainingunitrightsandmanagementprerogatives;
and
WHEREAS,theBoardofTrustees,havingconsultedwiththePresidentoftheUniversityandhis
negotiatingteam,findsthatitisinthebestinterestoftheUniversitythattheproposedagreementbe
approvedastheCollectiveBargainingAgreementBetweentheUniversityoftheDistrictofColumbia
andSEIU.

A.PursuanttotheCertificationofRepresentativeissuedbytheGovernmentoftheDistrictof

adjunctfacultypaidbythecourse,employedbytheUniversityoftheDistrictofColumbia.

A.TheEmployershallprovidetotheUnionapreliminarylistofalladjunctfacultymembers
coveredbythisAgreementonSeptember30andJanuary31ofeachyearfortheFalland
Springsemesters,respectivelyandtwoweeksfollowingthebeginningofeachSummer
session,
B.Thislistwillincludethefollowinginformation:name,mailingaddress,phonenumber,UDC
email,andthesemestertheadjunctfacultymemberfirsttaughtatUDC(iftheinformationis
availableonthehumanresourcesinformationsystem).Foreachadjunctfacultymemberon
thelisttheEmployerwilllistthefollowinginformationforeachcourse:   +Allcoursestaughtbytheadjunctfacultymemberduringthesemester

Article3-UnionRights
A.TherepresentativesoftheUnionshallhavereasonableaccesstotheEmployer'sacademic
facilitiesforthetransactionofnecessaryUnionbusinessrelatingtothisAgreementsolong.
asnormalbusinessandclassroomactivitiesarenotdisruptedorattemptedtobedisrupted.
B.TheUnionshallhaveaccesstomeetingspaceoncampus,subjecttothesameproceduresas
othercampusorganizationsandtheUniversity'sability,withinitsreasonablediscretion,to
makesuchspaceavailable.
C.TheUnionshallnotifytheUniversityofitsofficersandanyadjunctfacultymember
representatives.
Article4-UnionDues,Authorization
A,EmployeesmayauthorizeunionduesdeductionsdirectlythroughtheDistrictGovernment's
automatedPeopleSoftsystem.TheUniversityandtheUnionshallcollaboratetoimplement
theautomatedsystemandovertime,seektoaddenhancedfeatures,includingbutnotlimited
toinitiationfeesandpoliticalactioncontributions(PAC).
B.DeducteddueswillberemittedtotheUnioninaccordancewiththepayrollschedules
establishedbytheDistrictGovernment,OfficeofPayandRetirementServices.
C.Oncetheautomatedsystemhasbeenimplemented,theUniversityagreestofacilitate
resolutionofanyerrorsuponnoticebytheUnion.   Article5-ProceduresRegardingDevelopmentofHandbook
TheJointLaborManagementCollaborationCommitteeshallreviewexistingAdjunct
HandbooksandmakerecommendationsforonestandardizedhandbookforallUniversity
AdjunctFacultymembers.SuchrecommendationsshallbemadetotheChiefAcademicOfficer,
andnothingcontainedinthehandbookshallinfringeuponorcompromisetheUniversity'stotal
discretioninthehiring,appointmentorevaluationofadjunctfaculty.Furthermore,totheextent
thattheCommittee'srecommendationsincludesubjectswithintheUniversity'sManagement
Rights,theUniversityreservestherighttoinstitutesuchhandbookprovisionswithoutbargaining
withtheUnion.
Article6-CommunicationsRegardingAssignments
‘A_Ingeneral,eachadjunctfacultymemberishiredsolelyforasemester;however,the
Universitymay,atitsdiscretion,hireadjunctfacultyforafullacademicyear.TheUniversity
shallexclusivelydeterminewhethertohireapersonasanadjunctfacultymemberwithout
regardtowhetherthatadjunctfacultymemberhadbeenpreviouslyemployedasanadjunct
facultymemberinanycapacitywiththeUniversity.Thisrighttohireshallbeexclusiveto
theUniversityandnotsubjecttothegrievanceprocedure.
B.ShouldtheUniversityhireafacultymember,saidmembershallbenotifiedinwritingofits
determination,alongwiththespecificsoftheassignment,includinganyspecific
requirementsand/orexpectationsuponwhichthefacultymembershallbeevaluated.
C.Thedepartmentchairshallagreetomeetwiththefacultymemberathisorherrequest,in
advanceofthefirstsessionoftheclass,toprovideneededclarificationoftheexpectationsof
teachingestablishedbytheUniversity.
D.Whenanadjunctfacultymemberhasbeenassignedacourse,UDCshallpromptlyassign
theirnametothatcourseintheUDConlinescheduleofcoursesinthemannerinwhichthe
Universitynormallycommunicatessuchinformation.
E.Ifanadjunctfacultymember'sassignedcourseorassignmentiscancelled,thedepartment
shallpromptlynotifytheadjunctfacultyofthechange.
F.TheEmployeriscommittedtocontinuingitspracticeofrecognizingwellqualifiedadjunct
facultywhohavetaughtsuccessfullyatUDC.Thepartieshaveasharedinterestinarobust
evaluationsystemthatcanbeusedtoidentifysuchwellqualifiedadjunctfaculty.Oncethe   evaluationsystemhasbeenestablishedandimplemented,thepartiesagreetocollaborate
throughtheJointLaborManagementCollaborationCommitteetodeveloprecommendations
fortheChiefAcademicOfficertoretainexcellentadjunctfaculty.
Article7-Evaluations
A.Thepurposeofevaluationsistosupportexcellenceinteachingandadherencetoacademic
andprofessionalstandards,Adjunctfacultymemberswillbeevaluatedinamanner
consistentwiththestandardsandexpectationsoftheUniversity.
B.StudentCourseEvaluations
1.Courseevaluationsaremadeavailabletostudentsfortheirinputonallcoursesat
UDC.Adjunctfacultymembersshallcooperatewiththeappropriateacademic
administrators,asneeded,tofacilitatethestudentevaluationprocess.
2.Studentcourseevaluationswillbemadeavailabletotheadjunctfacultymember
throughtheUniversity’snormaldistributionprocessfromOPIEtothe
Colleges/Schoolsorthroughtheelectronicsystemwhereintheevaluationsarestored.
3.Inadditiontostudentevaluations,theadjunctfacultymembersmayrequestfeedback
fromtheUniversitybasedonclassroomobservationinaccordancewithparagraphsC
andDbelow.
C.ClassroomObservations.TheUniversitymayobserveteachingperformanceatanytime,
whetherrequestedbythefacultymemberorindependently.Anadjunctfacultymemberwill
normallybeprovidedadvancenoticeofsuchanobservation,buttheUniversityreservedthe
righttoconductclassroomobservationsatanytime,withoutpriornotification.Theadjunct
facultymemberwillreceivewrittenfeedbackontheobservationnolaterthantwoweeks
afterthedateofobservation.Followingreceiptofthewrittenclassroomobservationreport,
anadjunctfacultymembermayrequesttomeetwiththeclassroomobserverand/or
leadershipfromtheSchool/College,department,orprogramtodiscussorseekclarification
aboutthefeedback.Ameetingrequestedbytheadjunctfacultymembershallbecompleted
withintwoweeksofthedateoftherequest.
D.Classroomobservationreportsareforinformationalanddevelopmentalpurposesandshall
notbesubjecttogrievance
Article8-AccesstoServices-DepartmentSupport
A.Adjunctfacultymembersmustattendmandatoryorientations(newemployeeand
department/division),whichwillpreparethemtoperformtheirjobs.Thenewemployee
orientationwillcoveradministrativematterspertainingtoUniversityemployment.
Department/Divisionorientationswillincludeinformationregardingacademicprioritiesand
updatesonpoliciesandprocedures.   1.AdjunctFacultymembersattendingDepartment/Divisionorientationshallreceivea
stipendof$100.00fortheirattendance,andthatpaymentwillbeincludedinthe
adjunctfacultymember'sregularpayrollcheck.
2.AdjunctFacultymembersandtheUnionwillbegivenadequatenoticeofthetime
andlocationoforientation.
3.TheUniversityshallmakeareasonableefforttoaccommodateadjunctfaculty
memberswhoareunabletoattendDepartment/Divisionorientations.
B.Department/Divisionsshallmakeavailabletoadjunctfacultymembersallpertinent
informationabout(I)teachingassignment(s),(2)informationaboutupdatestotheHandbook
‘forAdjuncts(3)generalacademicpoliciesandpriorities,and(4)Department/Division
specificguidelinesandprocedures.
".TheUniversityshallestablishandmakeavailabletoalladjuncts,theprocedurestorequest
fundsforclassroomexperiencesatthestartofeachacademicyear.
.Whenadjunctfacultyareassignedtoteachcoursesthatrequirespecializedsupplies,
software,and/orequipment,theDepartment/DivisionChairmayrequestadditionalsupport
fromtheDeanonbehalfoftheadjunct.Suchcoursesshallbeidentifiedinthecurriculum
andapprovalforanyadditionalsupportrequestedwillbesolelydeterminedbytheDean
basedonavailableresources.
 
.TheUniversitywillmakeagoodfaithefforttoensurethatadjunctfacultyhaveaccessto
universityfacilitiesafterhoursthatarenecessaryforinstruction(forexample,copy
machines,printers,andpaper).Atthestartofthe2024Fallsemester,theUniversitywill
haveestablishedprocedurestoensurethatadjunctfacultyhaveregularaccesstonecessary
facilitiesandequipmentforinstructionafterhours.
 
.EachadjunctfacultymemberwillbeassignedaUDCemailatthetimeoftheinitialteaching
appointment.ItistheUniversity'spolicythatalladjunctfacultyusetheUniversity-assigned
emailaddressforallofficialcommunicationsandmatterspertainingtothecoursesand
studentstheyhavebeenassignedtoteach.TheUDCemailistheofficialrecordforall
Universitybusiness.
TheUniversityshallmakegoodfaitheffortstohavespaceavailableforadjunctfaculty
memberstoprepareforclassandmeetwithstudents.   H,Adjunctfacultymembersshallhaveaccesstoresearchdatabases,onlineservices,library
services,andotherapplicableUniversityresourcesduringcurrentteachingappointments.
Article9-JointLabor-ManagementCollaborationCommittee
A.TheUniversityandtheUnionarecommittedtoacollaborativerelationshipthatfosters
effectiveongoingcommunicationandaddressesissuesandconcernswithsolutionsthatare
inthebestinterestoftheparties.Tothatend,thepartiesagreetothecreationofaJoint
Labor-ManagementCollaborationCommittee.

C.TheJointLabor-ManagementCollaborationCommitteeshallconsiderandmake
recommendationsonmattersofgeneralimportancetotheadjunctfacultyand/orUDC.
D.TheJointLabor-ManagementCollaborationCommitteeshallmeetoncepersemester,
includingsummer,foratotalofthree(3)timesperacademicyear.Designated
representativesoftheUnionandUDCwillsuggestagendaitemsone(1)weekpriortoeach
meeting.Thepartieswilldesignatetheirownrepresentativestothecommittee.
Article10-AcademicFreedom
SubjecttothetermsofthisAgreement,adjunctfacultymembersshallbecoveredbythe
University'sacademicfreedompolicy.
Article11-CommunicationandAccesstotheAcademicCommunity
‘A.AdjunctfacultymemberswillfollowUDC'spolicyonplagiarism,academicintegrity,and
theStudentCodeofConduct,andwillbesupportedandassistedinholdingstudents
accountableunderthosepolicies.
B.TheUniversityshallmakeagoodfaithefforttonotifyadjunctfacultymembersabout
respectiveColleges/SchoolsandAcademicDepartments/Divisionsmeetings.Eachadjunct
facultymemberwillbeassignedaUDCemailatthetimeoftheinitialteachingappointment.   ItistheUniversity'spolicythatalladjunctfacultyusetheUniversity-assignedemailaddress
forallofficialcommunicationsandmatterspertainingtothecoursesandstudentstheyhave
beenassignedtoteach.TheUDCemailistheofficialrecordforallUniversitybusiness.
C.TheUniversityshallregularlycommunicatewithadjunctfacultyonissuesthatinvolve
adjunctfaculty,suchaspoliciesandproceduresandsubjectsrelatingtoAcademicmatters.
D.Fromtimetotime,AcademicDepartments/Divisionsmayencourageinputandfeedback
regardingcurriculumfromadjunctfaculty.
E.Whenappropriate,adjunctfacultymembersmayapplytoparticipateingrants,StudyAbroad
programsandothersuchopportunitieswhereavailable,andtheAcademic
Departments/Divisionsshallmakeagoodfaithefforttonotifyadjunctfacultymemberswhen
suchopportunitiespresentthemselves.
Article12-Non-discrimination
A.TheEmployerandtheUnionbothrecognizetheirresponsibilitiesunderFederal,State,and
DistrictofColumbialaws,andUniversitypolicypertainingtodiscriminationinemployment
andaprohibitionagainstsexualharassmentintheworkplace.Accordingly,bothparties
reaffirmbythisAgreementacommitmentnottodiscriminateagainstanypersonorpersons
becauseofaprotectedclassstatusunderFederaland/orDistrictofColumbialaws.The
partiesagreethatcomplaintsregardinganyandallofthesesubjectsmustbepresentedtothe
University'sEEOOfficerand/ortoanappropriategovernmentalAgencyandare,therefore,
notsubjecttothegrievanceprocedurecontainedinthisAgreement.
B.ProtectedclassstatusunderDistrictofColumbialawisextendedtopersonsonthefollowing
basis:race,color,religion,nationalorigin,sex,age,maritalstatus,personalappearance,
sexualorientation,genderidentityorexpression,familialstatus,familyresponsibilities,
physicaldisability,sourceofincomeandplaceofresidenceorbusiness,matriculation,o
politicalaffiliation.
  
C.TheUniversityandtheUnionshallnotdiscriminateagainstanyadjunctfacultymemberon
thebasisofhisorherprotectedUnionactivitiesoronthebasisofhisorherstatutoryright
nottoengageinsuchactivities.   Article13-HealthandSafety
‘TheUniversityandtheUnionarecommittedtoprovidingahealthyandsafeworking
environmentforalladjunctfacultymembers.
Article14-Payday
AdjunctfacultyshallbepaidonceamonthduringtheFallandSpringsemestersandtwicea
monthduringtheSummersessions.DuringthefirstyearofthisAgreement,theUniversityshall
makeagoodfaithefforttodevelopaninternalcapacitytopayadjunctfacultymembersona
twiceamonthbasisduringtheFallandSpringsemesters.
Article15-Compensation
A.AdjunctfacultywhotaughtinAY2022-2023willnotreceivearetroactiveadjustmentin
theirsalary.
B,AdjunctfacultymemberswhoteachinanysemesterorsummertermofAY2023-2024will
receiveaone-timelump-sumpaymentof$1.000.Thelump-sumpaymentwillbepaidas
soonaspossiblebutnolaterthansixty(60)calendardaysafterapprovalofthecontractby
theCounciloftheDistrictofColumbia,exceptthatadjunctfacultywhoteachonlyinthe
summertermofAY2023-2024shallbepaidthelump-sumnolaterthanthirty(30)daysafter
theendoftheir2024summerteachingcontract.Thisarticleisnotsubjecttogrievance.
C.Adjunctfacultymemberswillreceiveacostoflivingadjustment(COLA)of3%inAY
2024-2025.
D.CourseCancellationFee:Ifacourseanadjunctfacultymemberisappointedtoteachis
canceledforanyreasonlessthanten(10)daysbeforethedateofthefirstclass,the
Universityshallpaytheadjunctfacultymemberacoursecancellationfeeof$400.Ifacourse
anadjunctfacultymemberisappointedtoteachiscanceledwithintwenty-one(21)daysafter
thedateofthefirstclass,theUniversityshallcompensatetheadjunctfacultymemberona
pro-ratabasisfortheclassestaughtbeforecancellation.
E.CourseDevelopmentFee:ShouldtheUniversityrequestthatafacultymemberdevelopa
newfor-creditcourse(face-to-face,hybrid,oronline)andthecourseisapprovedbythe
University,thefacultymembershallreceiveacoursedevelopmentfeeof$1,500.Sucha   requestbytheUniversitymustbeapprovedbytheDeanandsubmittedforfinalapprovalby
theChiefAcademicOfficer.ThisprovisiondoesnotapplytothedevelopmentofQM
certifiedonlineversionsofexistingcourses;however,itdoesapplytonewfor-creditcourses
thataredevelopedspecificallyforonlinedeliveryandsubmittedforQMcertification.An
adjunctfacultymemberwhohasbeenapprovedbytheDeanandsubsequentlybytheChief
AcademicOfficertodevelopanewfor-creditonlinecourseshallbeauthorizedforthecourse
developmentfeewhenthecoursehasachievedofficialQMcertificationfromQualitymatters
(qualitymatters.org).
F.TheJointLabor-ManagementCollaborationCommitteewillmeettomakerecommendations
toUniversityManagementonmovementthroughapprovedsalarytiersbasedonan
establishedevaluationprocess.
G.AdjunctfacultywhoaremembersofSEIULocal500maypurchaseparkingatatwenty
percent(20%)reductionoftheUniversityparkingrateeachsemesterandthesummerterm
bythedateestablishedbytheUniversity.
Article16-ProfessionalDevelopmentFund
A.TheUniversityshallestablishaprofessionaldevelopmentfundforadjunctfaculty.The
professionaldevelopmentfundwillbeavailabletoadjunctsthroughacompetitive
applicationsubmissionprocess.Thefundwillprovidesupporttothoseactivitiesthatserveto
enhanceteachingexcellenceandthatcandemonstrateadirectrelationshipto,andimpacton,
theadjunct’steachingatUDC,includingpositiveimpactonstudents’professional
developmentand/orachievementoflearningoutcomes.TheChiefAcademicOfficerwillbe
responsibleforoversight,administration,andauthorizingapprovalsforthisfund.TheChief
‘AcademicOfficermayperiodicallyconsultwiththeJointLaborManagementCollaboration
Committeeforfeedbackabouttheprofessionaldevelopmentfund.
B.Thefundshalltotal$25,000ineachfiscalyearofthisagreement.Adjunctfacultymembers
whoareapprovedbytheDeanshallbeeligibleforreimbursementsupto$1,000towards
professionaldevelopmentactivitiesasspecifiedinparagraphAabove.
Article17-ManagementRights
A.Allrights,functions,andprerogativesofmanagement,whetherwrittenorunwritten,which
havenotbeenmodifiedorrestrictedbyanexpresswrittenprovisionofthisAgreement,are
retainedbytheUniversityandmaybeexercisedbytheUniversityinitssolediscretion.
‘Theserightsofmanagementshallinclude,butnotbelimitedto,therighttoestablish,plan,
directandcontroltheUniversity’smission,programs,objectives,activities,resources,and
    priorities;toestablishandadministerprocedures;rulesandregulations,anddirectand
controlUniversityoperations;toalter,extendordiscontinueexistingequipment,facilities,
andlocationofoperations;todetermineormodifythenumber,qualifications,scheduling,
responsibilitiesandassignmentofadjunctfacultymembers;toestablish,maintain,modifyor
enforcestandardsofperformance,conduct,orderandsafety;toevaluate,determinethe
contentoftheevaluations,anddeterminetheprocessesandcriteriabywhichadjunctfaculty
members!performanceisevaluated;toestablishandrequireadjunctfacultymembersto
observeUniversityrulesandregulations;todisciplineordismissadjunctfacultymembers
duringthecontracttermforjustcause;toestablishormodifytheacademiccalendars,
includingholidaysandholidayscheduling;toassignworklocations;toschedulehoursof
work;torecruit,hireortransfer;todeterminehowandwhenandbywhominstructionis
delivered;todeterminewhoistaught,whatistaught,howitistaught,andwhodoesthe
teaching;todetermineallmattersrelatingtoadjunctfacultyhiringandretentionand
studentadmissions;tointroducenewmethodsofinstruction;tosubcontractalloranyportion
ofanyoperations;andtoexercisesoleauthorityonalldecisionsinvolvingacademicmatters.
Management,innotexercisinganyfunctionherebyreservedtoitinthisArticleorin
exercisinganysuchfunctioninaparticularway,willnotbedeemedtohavewaiveditsright
toexercisesuchfunctionorprecludeManagementfromexercisingthesameinsomeother
way.NoactiontakenbytheUniversitywithrespecttoamanagementoracademicright
shallbesubjecttothegrievanceprocedureorcollateralsuitunlesstheexercisethereof
violatesanexpresswrittenprovisionofthisAgreement.
B.Totheextentnotfullyarticulatedabove,theUniversityshallalsoretainallrightsreserved
forManagementthatarecontainedwithintheD.C.Code1-617.08(a).
C.TheUniversityshallretaintheexclusiveauthoritytoestablishthetermofalladjunctfaculty
contractsandtorenewornotrenewsuchcontractsandthat,therefore,suchrenewalor
nonrenewalofsuchcontractsshallneitherbedeemedtobedisciplineasreferencedabovein
ParagraphAnorsubjecttothegrievanceproceduresandarbitrationwithinthiscollective
bargainingagreement.
D.NoactiontakenbytheUniversitywithrespecttoamanagementrightshallbesubjecttothe
grievanceorarbitrationprocedureorcollateralsuitunlesstheexercisethereofviolatesan
expresswrittenprovisionofthisAgreement.
Article18-GrievanceProcedureandArbitration
A.Thepartiesrecognizeandendorsetheimportanceofestablishingaprompt,fairandefficient
mechanismfortheorderlyresolutionofgrievancesandagreetousetheirbesteffortsto
10   encouragethepromptsettlementofsuchgrievances.Itisunderstoodthatnothinginthis
grievanceprocedureshalllimittheexistingrightofanadjunctfacultymemberto
communicatedirectlywithUniversityManagementwithoutgoingthroughthisprocedure.
B.Agrievanceisanallegationbyanemployee,groupofemployeeswheretheallegedviolation
involvesmorethanoneemployeeonthesameissue,and/ortheUnionthattheUniversityhas
violatedanexpressprovisionofthisAgreement.
C.Thegrievanceprocedureshalloperateasfollows:
1Anygrievanceshallbepresentednolaterthan(10)tencalendardaysaftertheevent
inquestionoccurredorifnotknown,presentedwithin(10)tencalendardaysfrom
thedate,when,withtheexerciseofreasonablediligence,itshouldhavebecome
known.Thegrievanceshallsetforthinwritinginplainlanguagetheaction
complainedof,thespecificprovision(s)ofthisAgreementthatwereallegedly
violated,andtheproposedremedy.Thegrievanceshallbepresentedtothe
DepartmentChair,ProgramDirector,orDivisionChairasthecasemaybewherethe
conducttookplace.TheUniversityshallhaveseven(7)calendardaystorespondto
thegrievance.
IfthematterisnotresolvedattheFirstStep,thennolaterthanseven(7)calendar
daysfromtheexpirationdateoftheFirstStep,theUnionshallpresentthegrievance
tothenextlevelofManagementauthority,namelytheDeanoftheCollegeorSchool.
TheDeanorProgramDirectororDivisionDirectorshallhaveseven(7)calendar
daystorespondtothegrievance.
IfthematterisnotresolvedattheSecondStep,thennolaterthanfive(5)calendar
daysfromtheexpirationdateoftheSecondStep,thegrievanceshallthenbe
presentedbytheUniontotheVicePresidentofHumanResourcesastheThirdStep.
TheVicePresidentofHumanResourcesshallhaveten(10)calendardaystorespond
tothegrievance.Ifthemeetingisnotheldwithinfifteen(15)calendardaysfollowing,
thedatethegrievancewaspresentedtotheVicePresidentofHumanResources,the
Universityshallhavethediscretiontorespondtothegrievance.
IfthegrievanceisnotresolvedattheThirdStep,TheUnionshallthenhave(10)ten
calendardaysfromtheconclusionofStep3toprovidenoticetotheUniversityofits
intenttosubmitthemattertoArbitration,TheUniversityandtheUnionagreeto
maintainatalltimes,apanelofthree(3)namedarbitrators,one(1)ofwhomshallbe
I   appointedtoheareachgrievancethatisappealedtoarbitration.Rotationof
arbitrationcasesamongsucharbitratorsshallbeinalphabeticalorderbythe
arbitrator'slastname.Asoftheeffectivedateofthisagreement,theUniversityand
theUnionhaveselectedJoanParker,SeanRogersandJosephSharnoffasmembers
ofsaidpanel.Ifonesucharbitratorisnolongeravailabletoserve,theUniversityand
theUnionshal!immediatelynameareplacementarbitrator.Thereplacement
arbitratorshallassumetheorderintherotationheldbythearbitratorthatheorsheis
replacing.Exceptinthecaseofthevoluntaryresignationofanamedarbitrator,no
arbitratormayberemovedbytheUniversityortheUnion,exceptbymutual
agreementoftheUniversityandtheUnion,orforcause.IftheUniversityorthe
Unionappealsthedecisionandawardofanarbitratortoacourtofappropriate
jurisdiction,thatarbitratorshallbesuspendedfromappointmentsunderthis
agreementpendingsuchappealandshallberemovedifthedecisionandawardisnot
upheldinfull.
5.ThedecisionoftheArbitratorshallbefinalandbindingastothepartiestothis
‘Agreementandthegrievant.Provided,however,thattheArbitratorshallhaveno
authoritytoaddto,subtractfrom,ortochangeanyofthetermsofthisAgreement.
6.Eachpartyshallbearitsownexpensesinpreparingandpresentingitsowncase.The
costoftheArbitrator'sservices,thetranscriptofthearbitration,andanyother
expensesincidentaltotheArbitrationshallbeborneequallybybothparties.
7.Whendeterminingwhetheratimelimitationreferenceabovehasbeenexceeded,the
daytheeventoccurredorthelastdaywhensuchactcouldhavebeentakenshallnot
becountedandthetimedeterminationshallcommenceonthenextday.Thefailureof
theUniversitytorespondwithinthetimelimitsofSteps1,2,and3,shallbedeemed
adenialofthegrievance.Otherwisestrictadherencetothetimelimitssetforthherein
shallbeadheredtoand,therefore,unlessawaiverofsuchtimelimitsismutually
agreedto,thefailuretomeetanyofthetimelimitssetforthhereinshallresultinthe
dismissalofthegrievance.Providedfurtherthatthefailuretoinvokethistimeisof
theessenceprovisionononeoccasionbytheUniversityshallnotbartheUniversity
frominvokingitonanotheroccasion.
Article19-NoStrikesNoLockouts
ConsistentwiththeDistrictofColumbialaw,theUnionshallneitherstrikenorengageinany
otherformofworkstoppageincludingaslowdown,orpicketingwhichphysicallyinterfereswith
12   theuniversity'soperations.Intheeventofanykindofsuchstrike,workstoppage,slowdown,
picketing,oranyotherinterferencewiththeUniversity'soperations,itshallaffirmativelytakeall
reasonableactiontoimmediatelyputahalttosuchconductandtheUniversityreservestheright
totakedisciplinaryactioninanyandallsuchinstances.ConsistentwiththeDistrictofColumbia
Jaw,theUniversityshallnotlockoutanybargainingunitemployee.
Article20-SavingsClause
A.Intheeventanyarticle,sectionorportionofthisAgreementisheldtobeinvalidand
unenforceablebyreasonofanyexistingorsubsequentlyenactedlaworbydecreeofany
courtorotherauthorityofcompetentjurisdiction,suchdecisionshallapplyonlytothe
specificarticle,section,orportionthereofspecifiedinthedecision;anduponissuanceof
suchlawordecision,theUniversityandtheUnionagreetoimmediatelynegotiatea
substitutefortheinvalidatedarticle,sectionorportionthereoftotheextentpossible.
B.ThetermsofthisAgreementsupersedeanyconflictingUniversityand/orDistrictPersonnel
Manual(DPM)regulationsconcerningnon-compensationorcompensationmatterscovered
hereinforthetermofthisAgreement.
Article21-Duration
UponratificationbytheUnionandtheBoardofTrusteesoftheUniversityandthereafter
approvalbytheCounciloftheDistrictofColumbia,thisAgreementshallbeinfullforceand
effectasofOctober1,2022untilmidnight,September30,2025.Andfromyeartoyear
thereafterunlesseitherpartynotifiestheotherpartyinwritingbyCertifiedMail,returnreceipt
requested,orbyelectronicmailproperlyaddressedtotheaddresseeduringtheperiodfrom120
daysto90dayspriortothefirstdayofthefiscalyearforthepurposesofnegotiatingan
agreementforthesubsequentfiscalyear.
13   Article22-EntireAgreement
‘TheunderstandingssetforthinthisAgreementshallconstitutethesoleandentireagreement
betweenthepartiesforthedurationhereof,MattersnotdirectlycoveredbythisAgreementshall
begovernedbyapplicableDistrictofColumbialaw.

IntemationalUnionCtW(SEIU)adjunctfaculty.Thetotalcostofthelumpsumpaymentand3%COLA

Background
TheUniversitywishestoimprovepayparitybetweenUDCServiceEmployeesInternational
UnionCtW(SEIU)adjunctfacultyandadjunctfacultyteachingatareainstitutionsofhigher
education.TheUniversitywishestomovetowardscompensatingUDCadjunctfacultycloserto
marketcomparability.SEIUandtheUniversitysuccessfullynegotiateda3%COLAinAY2023-
2024.
Toaccomplishthethreepercent(3%)increase,theUniversitymustadjustServiceEmployees
InternationalUnionCtW(SEIU)salariestoreflectthe3%increaseinsalariesandfringes.The
identifiedUDCemployeeswillreceivetheCOLAadjustmentsonOctober1,2024.Theone-timehump
sumpaymentwillbeissueduponapprovaloftheDCCouncil.
Thereareatotalof175ServiceEmployeesIntemationalUnionCtW(SEIU)adjunctfacultyeligible
toreceivethe3%COLA.
