 HOUSE BILL NO. 81 

   

 AN ACT TO AMEND TITLE 14 OF THE DELAWARE CODE RELATING TO CHARTER SCHOOL STUDENT TRANSPORTATION. 

   

  BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:   Section 1. Amend 508, Title 14 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:    508. Responsibility for student transportation.   (a) (1)   The  A  charter school may  do one of the following:   a.   request   Request  to have the school district where the charter school is located transport students residing in that district, at fair cost, to and from the charter school on the same basis offered to other students attending schools operated by the  district,   district.   b.   or to receive   Receive  from the State a payment equal to 70% of the average cost per student of transportation within the vocational district in which the charter school is located and become responsible for the transportation of those students to and from the charter school.   (2) A school district receiving a request under paragraph (a)(1)a. of this section from a charter school may deny the request.   (3) If a school district denies a request under paragraph (a)(2) of this section, the charter school is to receive the payment under paragraph (a)(1)b. of this section.      

 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

  SYNOPSIS   This Act makes clear that a school district may deny a request from a charter school to have the school district where the charter school is located to transport students residing in that district. If the school district denies the request, the charter school is to receive the payment provided by the State under existing law.
