Paragraph (g) of subsection (1) of section 15 501.2041, Florida Statutes, is amended to r ead: 16 501.2041 Unlawful acts and practices by social media 17 platforms.— 18 (1) As used in this section, the term: 19 (g) "Social media platform" means any information service, 20 system, Internet search engine, or access software provider 21 that: 22 1. Operates as a sole proprietorship, partnership, limited 26 liability company, corporation, association, or other legal 27 entity; 28 3. Does business in the state; and 29 4. Satisfies at least one of the following thresholds: 30 a. Has annual gross revenues in excess of $100 million, as 31 adjusted in January of each odd -numbered year to reflect any 32 increase in the Consumer Price Index. 33 b. Has at least 100 million monthly individual platform 34 participants globally. 35 36 The term does not include any information service, system, 37 Internet search engine, or access software provider operated by 38 a company that owns and operates a theme park or entertainme nt 39 complex as defined in s. 509.013. 40 Section 2. For the purpose of incorporating the amendment 41 made by this act to section 501.2041, Florida Statutes, in a 42 reference thereto, paragraph (c) of subsection (1) of section 43 106.072, Florida Statutes, is reen acted to read: 44 106.072 Social media deplatforming of political 45 candidates.— 46 (1) As used in this section, the term: 47 (c) "Social media platform" has the same meaning as in s. 48 501.2041. 49 Section 3. For the purpose of incorporating the amendment 50 HB 5C 2022C CODING: Words stricken are deletions; words underlined are additions. hb0005c-00 Page 3 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S made by this act to section 501.2041, Florida Statutes, in a 51 reference thereto, paragraph (f) of subsection (1) of section 52 287.137, Florida Statutes, is reenacted to read: 53 287.137 Antitrust violations; denial or revocation of the 54 right to transact busine ss with public entities; denial of 55 economic benefits.— 56 (1) As used in this section, the term: 57 (f) "Person" means a natural person or an entity organized 58 under the laws of any state or of the United States which 59 operates as a social media platform, as d efined in s. 501.2041, 60 with the legal power to enter into a binding contract and which 61 bids or applies to bid on contracts let by a public entity, or 62 which otherwise transacts or applies to transact business with a 63 public entity. The term includes those of ficers, directors, 64 executives, partners, shareholders, employees, members, and 65 agents who are active in the management of an entity. 66 Section 4. This act shall take effect upon becoming a law. 67
