Subsection (14) of section 315.03, Florida 25 HB 65 2022 CODING: Words stricken are deletions; words underlined are additions. hb0065-00 Page 2 of 5 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S Statutes, is amended to read: 26 315.03 Grant of powers. —Each unit is hereby authorized and 27 empowered: 28 (14)(a) To operate and maintain, and to fix and collect 29 rates, rentals, fees and other charges for any of the services 30 and facilities provided by the port facilities now or hereafter 31 acquired, owned or constructed by t he unit excluding state bar 32 pilots. 33 (b) A spaceport user who has been approved for the Zero G, 34 Zero Fee program pursuant to s. 331.3545 is exempt from any fees 35 or charges that apply to cargo while transporting a space 36 vehicle as defined in s. 331.303, la unch equipment, or recovery 37 equipment. This paragraph expires December 31, 2042. 38 Section 2. Subsections (17), (18), (19), (20), and (21) of 39 section 331.303, Florida Statutes, are renumbered as subsections 40 (18), (20), (21), (22), and (19), respectively, and a new 41 subsection (17) is added to that section, to read: 42 331.303 Definitions. — 43 (17) "Space vehicle" means a system used to transport 44 persons and payload from a spaceport territory to a destination 45 at or beyond 62 miles above sea level. 46 Section 3. Section 331.3545, Florida Statutes, is created 47 to read: 48 331.3545 Tax exemption; certain aerospace materials and 49 consumables.— 50 HB 65 2022 CODING: Words stricken are deletions; words underlined are additions. hb0065-00 Page 3 of 5 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S (1) SHORT TITLE.—This section may be cited as the "Zero G, 51 Zero Fee Act." 52 (2) CREATION.—The Zero G, Zero Fee program is created for 53 the purpose of granting tax exemptions for the sale, rental, 54 storage, use, or consumption of certain aerospace materials and 55 consumables by spaceport users as defined in s. 331.303. 56 (3) APPLICATION; ELIGIBILITY. —Space Florida shall, by 57 rule: 58 (a) Determine spaceport user eligibility criteria for the 59 Zero G, Zero Fee program and create the program application 60 process. 61 (b) Create a list of materials and consumables qualified 62 for the program, including, but not limited to: 63 1. Materials and consumables used for the construction of 64 space vehicles, launch pads, landing pads, and space vehicle 65 recovery assets. 66 2. Materials and consumables used for the construction of 67 payloads, space stations, and extravehicular equipment. 68 3. Vehicle propellan t and other chemicals and gases 69 necessary for construction, launch, recovery, and reusability of 70 space vehicles. 71 (4) PROHIBITION ON TAX OR FEE. —Notwithstanding any other 72 provision of law, the state may not assess a tax or fee on a 73 spaceflight vehicle, or any component of a spaceflight vehicle, 74 for the ascent, descent, or landing of such spaceflight vehicle 75 HB 65 2022 CODING: Words stricken are deletions; words underlined are additions. hb0065-00 Page 4 of 5 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S on land or territorial waters of the state. 76 (5) EXPIRATION.—This section expires December 31, 2042. 77 Section 4. Paragraph (a) of subsection (1) of section 78 338.155, Florida Statutes, is amended to read: 79 338.155 Payment of toll on toll facilities required; 80 exemptions.— 81 (1)(a) A person may not use a toll facility without 82 payment of tolls, except: 83 1. An employee of the agency operating the toll pr oject 84 when using the toll facility on official state business. 85 2. State military personnel while on official military 86 business. 87 3. A person with a disability as provided in subsection 88 (3). 89 4. A person exempt from toll payment by the authorizing 90 resolution for bonds issued to finance the facility. 91 5. A person exempt on a temporary basis where use of such 92 toll facility is required as a detour route. 93 6. A law enforcement officer operating an official vehicle 94 while on official law enforcement business . 95 7. A person operating a fire vehicle while on official 96 business or a rescue vehicle while on official business. 97 8. A spaceport user who has been approved for the Zero G, 101 Zero Fee program pursuant to s. 331.3545 while transporting a 102 space vehicle as defined in s. 331.303, launch equipment, or 103 recovery equipment. This subparagraph expires December 31, 2042. 104 Section 5. The Secretary of Business and Professional 105 Regulation shall review current professional rules and 106 regulations and shall recommend to the Legislature the 107 elimination of rules or regulations that he or she determines 108 are detrimental to the commercial aerospace indu stry. The 109 secretary shall submit a report of his or her findings to the 110 Governor, the President of the Senate, the Speaker of the House 111 of Representatives, and the board of directors of Space Florida 112 no later than December 31, 2022. 113 Section 6. This act shall take effect July 1, 2022. 114
