A bill to be entitled 1 
An act relating to limiting COVID -19 restrictions; 2 
prohibiting the state or any political subdivision 3 
from enacting a mask mandate; providing that any such 4 
mandate is void and of no effect; prohibiting state 5 
and local governments from requiring COVID -19 6 
vaccinations, issuing vaccine passports or other 7 
standardized documentation to third parties, or 8 
otherwise publishing or sharing COVID -19 vaccination 9 
records or similar health information; providing 10 
construction; prohibiting businesses from requiring 11 
patrons or customers to provide documentation 12 
certifying COVID-19 vaccination or COVID -19 post-13 
transmission recovery to gain access to, entry upon, 14 
or service from the business; prohibiting businesses 15 
from discriminating against patrons or customers on 16 
the basis of, or the failure to provide information 17 
concerning, their COVID -19 vaccination status or 18 
COVID-19 post-transmission recovery status; creating 19 
s. 760.101, F.S.; declaring that certain actions based 20 
on vaccination status or having an immunity passport 21 
are unlawful discriminatory practices; providing an 22 
effective date. 23

Be It Enacted by the Legislature of the State of Florida: 25

 Section 1.  (1)  It is unlawful for this state, or any 27 
political subdivision thereof, to adopt or enact any law, order, 28 
rule, regulation, or plan of action that requires a person in 29 
this state to wear a mask or other facial covering to minimize 30 
the spread of COVID-19 or any other infectious disease. 31 
 (2)  Any such unlawful mask mandate is invalid in this 32 
state, may not be recognized in this state, and is null, void, 33 
and of no effect. 34 
 Section 2.  (1)  A state governmental entity, a political 35 
subdivision, or any agents or assigns of the entity or 36 
subdivision may not require a COVID -19 vaccination; issue a 37 
vaccine passport, vaccine pass, immunity passport, or other 38 
standardized documentation for the purpose of certifying an 39 
individual's COVID-19 vaccination status to a third party; or 40 
otherwise publish or share any individual's COVID -19 vaccination 41 
record or similar health information. This subsection does not 42 
apply to the immunization and documentation requirements under 43 
s. 1003.22, Florida Statutes, as they existed on July 1, 2021.  44 
 (2)  A business in this state may not require patrons or 45 
customers to provide any documentation certifying COVID -19 46 
vaccination or COVID -19 post-transmission recovery to gain 47 
access to, entry upon, or service from the business or 48 
discriminate in any way against a patron or customer on the 49 
basis of, or the failure to provide information concerning, his 50

or her COVID-19 vaccination status or COVID -19 post-transmission 51 
recovery status. 52 
 Section 3.  Section 760.101, Florida Statutes, is created 53 
to read: 54 
 760.101  Discrimination based on vaccination status or 55 
immunity passport.—It is an unlawful discriminatory practice 56 
for: 57 
 (1)  A person or governmental entity to refuse, withhold 58 
from, or deny a person any local or state services, goods, 59 
facilities, advantag es, privileges, licensing, educational 60 
opportunities, health care access, or employment opportunities 61 
based on the person's vaccination status or whether the person 62 
has an immunity passport; 63 
 (2)  An employer to refuse employment to a person, bar a 64 
person from employment, or discriminate against a person in 65 
compensation or in a term, condition, or privilege of employment 66 
based on the person's vaccination status or whether the person 67 
has an immunity passport; or 68 
 (3)  A public accommodation to exclude, limit , segregate, 69 
refuse to serve, or otherwise discriminate against a person 70 
based on the person's vaccination status or whether the person 71 
has an immunity passport. 72 
 Section 4.  This act shall take effect upon becoming a law. 73
