HJR 177 2022 CODING: Words stricken are deletions; words underlined are additions. hjr0177-00 Page 1 of 3 F L O R I D A H O U S E O F R E P RE S E N T A T I V E S House Joint Resolution 1 A joint resolution proposing an amendment to Section 5 2 of Article XI of the State Constitution to increase 3 the percentage of elector votes required to approve an 4 amendment to or a revision of the State Constitution 5 from 60 percent to 66.67 percent, except that the 6 repeal of an amendment or revision need only be 7 approved by the same percentage of elector votes as 8 was required at the time of passage of such amendm ent 9 or revision. 10 11 Be It Resolved by the Legislature of the State of Florida: 12 13 That the following amendment to Section 5 of Article XI of 14 the State Constitution is agreed to and shall be submitted to 15 the electors of this state for approval or rejecti on at the next 16 general election or at an earlier special election specifically 17 authorized by law for that purpose: 18 ARTICLE XI 19 AMENDMENTS 20 SECTION 5. Amendment or revision election. — 21 (a) A proposed amendment to or revision of this 22 constitution, or any pa rt of it, shall be submitted to the 23 electors at the next general election held more than ninety days 24 after the joint resolution or report of revision commission, 25 HJR 177 2022 CODING: Words stricken are deletions; words underlined are additions. hjr0177-00 Page 2 of 3 F L O R I D A H O U S E O F R E P RE S E N T A T I V E S constitutional convention or taxation and budget reform 26 commission proposing it is filed with the custodian of state 27 records, unless, pursuant to law enacted by the affirmative vote 28 of three-fourths of the membership of each house of the 29 legislature and limited to a single amendment or revision, it is 30 submitted at an earlier special election held m ore than ninety 31 days after such filing. 32 (b) A proposed amendment or revision of this constitution, 33 or any part of it, by initiative shall be submitted to the 34 electors at the general election provided the initiative 35 petition is filed with the custodian of state records no later 36 than February 1 of the year in which the general election is 37 held. 38 (c) The legislature shall provide by general law, prior to 39 the holding of an election pursuant to this section, for the 40 provision of a statement to the public rega rding the probable 41 financial impact of any amendment proposed by initiative 42 pursuant to section 3. 43 (d) Once in the tenth week, and once in the sixth week 44 immediately preceding the week in which the election is held, 45 the proposed amendment or revision, wi th notice of the date of 46 election at which it will be submitted to the electors, shall be 47 published in one newspaper of general circulation in each county 48 in which a newspaper is published. 49 (e) Unless otherwise specifically provided for elsewhere 50 HJR 177 2022 CODING: Words stricken are deletions; words underlined are additions. hjr0177-00 Page 3 of 3 F L O R I D A H O U S E O F R E P RE S E N T A T I V E S in this constitution, if the proposed amendment or revision is 51 approved by vote of at least sixty-six and sixty-seven 52 hundredths sixty percent of the electors voting on the measure, 53 it shall be effective as an amendment to or revision of the 54 constitution of the s tate on the first Tuesday after the first 55 Monday in January following the election, or on such other date 56 as may be specified in the amendment or revision. However, the 57 repeal of an amendment to or a revision of this constitution 58 only requires the approval by vote of at least the same percent 59 of the electors as was required at the time of passage of such 60 amendment or revision. 61 BE IT FURTHER RESOLVED that the following statement be 62 placed on the ballot: 63 CONSTITUTIONAL AMEND MENT 64 ARTICLE XI, SECTION 5 65 REQUIRING BROADER PU BLIC SUPPORT FOR CON STITUTIONAL 66 AMENDMENTS OR REVISI ONS.—Proposing an amendment to the State 67 Constitution to increase the percentage of elector votes 68 required to approve an amendment to or a revision of the State 69 Constitution from 60 pe rcent to 66.67 percent, except that the 70 repeal of an amendment or revision need only be approved by the 71 same percentage of elector votes as was required at the time of 72 passage of such amendment or revision. 73
