A bill to be entitled 1 
An act relating to swimming pool specialty contracting 2 
services; amending s. 489.117, F.S.; authorizing 3 
certain persons under the supervision of specified 4 
licensed contractors to perform certain specialty 5 
contracting services for commercial or residential 6 
swimming pools, interactive water features, hot tubs, 7 
and spas; providing that such supervision does not 8 
require a direct contract between those persons; 9 
providing construction; providing an effective date. 10

Be It Enacted by the Legislature of the State of Florida: 12 
 13 
 Section 1.  Paragraph (e) is added to subsection (4) of 14 
section 489.117, Florida Statutes, to read: 15 
 489.117  Registration; specialty con tractors.— 16 
 (4) 17 
 (e)  Any person who is not certified or registered may 18 
perform the work of a specialty contractor whose scope of 19 
practice is limited to the type of work specified under s. 20 
489.105(3)(j), (k), or (l) for the construction, remodeling, 21 
repair, or improvement of commercial or residential swimming 22 
pools, interactive water features as defined in the Florida 23 
Building Code, hot tubs, and spas without obtaining a local 24 
license or certification as a specialty contractor if he or she 25

is supervised by a contractor who is certified or registered 26 
under s. 489.105(3)(j), (k), or (l); the work is within the 27 
scope of the supervising contractor's license; the supervising 28 
contractor is responsible for the work; and the work does not 29 
require certification or re gistration under s. 489.105(3)(d) -30 
(i), (m)-(o), or s. 489.505. Such supervision does not require a 31 
direct contract between the contractor certified or registered 32 
under s. 489.105(3)(j), (k), or (l) and the person performing 33 
the work, or for the person perf orming the work to be an 34 
employee of the contractor certified or registered under s. 35 
489.105(3)(j), (k), or (l). This paragraph does not limit the 36 
exemptions provided in s. 489.103 and may not be construed to 37 
expand the scope of a contractor certified or r egistered under 38 
s. 489.105(3)(j), (k), or (l) to provide plumbing or electrical 39 
services for which certification or registration is required by 40 
this part or part II. 41 
 Section 2.  This act shall take effect July 1, 2022. 42
