21	21	state by a specified date; requiring certain 8
22	22	information to be included in the database; requiring 9
23	23	a legislative appropriation from the Division of 10
24	24	Florida Condominiums, Timeshares, and Mobile Homes 11
25	25	Trust Fund to create, operate, and maintain the 12
26	26	database; providing an effective date. 13

28	28	Be It Enacted by the Legislature of the State of Florida: 15

30	30	Section 1. Section 718.5041, Florida Statutes, is created 17
31	31	to read: 18
32	32	718.5041 Condominium association dat abase.—By January 1, 19
33	33	2023, the Division of Florida Condominiums, Timeshares, and 20
34	34	Mobile Homes shall create, maintain, and annually update a 21
35	35	publicly-accessible Internet database of condominium 22
36	36	associations in the state. 23
37	37	(1) The searchable database must i nclude the following 24
38	38	information for each condominium association in the state: 25

51	51	(a) The name, e-mail address, and telephone number of each 26

53	53	(b) The name, e-mail address, and telephone number of the 28

56	56	(c) A copy of the association's governing documents, 31
57	57	including, but not limited to: 32
58	58	1. The recorded declaration of condominium and any 33
59	59	amendments thereto. 34
60	60	2. The articles of incorporation of the association, or 35
61	61	other documents creating the association, and any amendments 36
62	62	thereto. 37
63	63	3. The recorded bylaws and any amendments thereto. 38
64	64	(d) A copy of the annual budget and a schedule of expenses 39
65	65	for each type of unit, including fees assessed pursuant to s. 40
66	66	718.113(1), for each condominium that the association operates. 41
67	67	In addition, the database must specify whether the association 42
68	68	has reserve accounts for capital expenditures and deferred 43
69	69	maintenance and if they are fully funded. 44
70	70	(e) If a reserve study has been c onducted, a copy of the 45
71	71	most recent reserve study. 46
72	72	(f) A copy of the inspection report described in s. 47
73	73	718.301(4)(p). 48
74	74	(2) The Legislature shall appropriate funds from the 49
75	75	Division of Florida Condominiums, Timeshares, and Mobile Homes 50

90	90	Section 2. Section 720.4012, Florida Statutes, is created 53

93	93	2025, the Division of Florida Condominiums, Timeshares, and 56
94	94	Mobile Homes shall create, maintain, and annually update a 57
95	95	publicly-accessible Internet database of homeowners' 58

98	98	information for each homeowners' association in the state: 61
99	99	(a) The name, e-mail address, and telephone number of each 62

106	106	amount, including any special assessments, charged to parcel 69
107	107	owners. In addition, the database must specify whether the 70

126	126	areas or other property that the association is obligated to 77

128	128	(2) The Legislature shall appropriate funds from the 79
129	129	Division of Florida Condominiums, Timeshares, and Mobile Homes 80
130	130	Trust Fund for the creation, operation, and maintenance o f the 81

132	132	Section 3. This act shall take effect July 1, 2022. 83
