A bill to be entitled 1 
An act relating to community association databases; 2 
creating ss. 718.5041 and 720.4012, F.S.; directing 3 
the Division of Florida Condominiums, Timeshares, and 4 
Mobile Homes to create, maintain, and update a 5 
publicly-accessible Internet database of condominiu m 6 
and homeowners' associations, respectively, in the 7 
state by a specified date; requiring certain 8 
information to be included in the database; requiring 9 
a legislative appropriation from the Division of 10 
Florida Condominiums, Timeshares, and Mobile Homes 11 
Trust Fund to create, operate, and maintain the 12 
database; providing an effective date. 13 
 14 
Be It Enacted by the Legislature of the State of Florida: 15 
 16 
 Section 1.  Section 718.5041, Florida Statutes, is created 17 
to read: 18 
 718.5041  Condominium association dat abase.—By January 1, 19 
2023, the Division of Florida Condominiums, Timeshares, and 20 
Mobile Homes shall create, maintain, and annually update a 21 
publicly-accessible Internet database of condominium 22 
associations in the state. 23 
 (1)  The searchable database must i nclude the following 24 
information for each condominium association in the state: 25

 (a)  The name, e-mail address, and telephone number of each 26 
board member. 27 
 (b)  The name, e-mail address, and telephone number of the 28 
community association manager or communit y association 29 
management company, if any. 30 
 (c)  A copy of the association's governing documents, 31 
including, but not limited to: 32 
 1.  The recorded declaration of condominium and any 33 
amendments thereto. 34 
 2.  The articles of incorporation of the association, or 35 
other documents creating the association, and any amendments 36 
thereto. 37 
 3.  The recorded bylaws and any amendments thereto. 38 
 (d)  A copy of the annual budget and a schedule of expenses 39 
for each type of unit, including fees assessed pursuant to s. 40 
718.113(1), for each condominium that the association operates. 41 
In addition, the database must specify whether the association 42 
has reserve accounts for capital expenditures and deferred 43 
maintenance and if they are fully funded. 44 
 (e)  If a reserve study has been c onducted, a copy of the 45 
most recent reserve study. 46 
 (f)  A copy of the inspection report described in s. 47 
718.301(4)(p). 48 
 (2)  The Legislature shall appropriate funds from the 49 
Division of Florida Condominiums, Timeshares, and Mobile Homes 50

Trust Fund for the creation, operation, and maintenance of the 51 
database. 52 
 Section 2.  Section 720.4012, Florida Statutes, is created 53 
to read: 54 
 720.4012  Homeowners' association database. —By January 1, 55 
2025, the Division of Florida Condominiums, Timeshares, and 56 
Mobile Homes shall create, maintain, and annually update a 57 
publicly-accessible Internet database of homeowners' 58 
associations in the state. 59 
 (1)  The searchable database must include the following 60 
information for each homeowners' association in the state: 61 
 (a)  The name, e-mail address, and telephone number of each 62 
board member. 63 
 (b)  The name, e-mail address, and telephone number of the 64 
community association manager or community association 65 
management company, if any. 66 
 (c)  A copy of the association's governing docume nts. 67 
 (d)  A copy of the annual budget and the current assessment 68 
amount, including any special assessments, charged to parcel 69 
owners. In addition, the database must specify whether the 70 
association has reserve accounts for capital expenditures and 71 
deferred maintenance and if they are fully funded. 72 
 (e)  If a reserve study has been conducted, a copy of the 73 
most recent reserve study. 74 
 (f)  Copies of any plans, specifications, permits, and 75

warranties related to improvements constructed on the common 76 
areas or other property that the association is obligated to 77 
maintain, repair, or replace. 78 
 (2)  The Legislature shall appropriate funds from the 79 
Division of Florida Condominiums, Timeshares, and Mobile Homes 80 
Trust Fund for the creation, operation, and maintenance o f the 81 
database. 82 
 Section 3.  This act shall take effect July 1, 2022. 83
