state and regional programs to regulate greenhouse gas 5
emissions without specific legislative authorization; 6
providing an effective date. 7

Be It Enacted by the Legislature of the State of Florida: 9

Section 1. Section 403.08723, Florida Statutes, is created 11
to read: 12
403.08723 Regulation of greenhouse gas emissions. — 13
(1) As used in this section, the term "greenhouse gas" 14
means carbon dioxide, methane, nitrous oxide, sulfur 15
hexafluoride, hydrofluorocarbon, and perfluorocarbon. 16
(2) Notwithstanding any other law, a state agency may not 17
adopt or enforce a state or regional program to regulate 18
greenhouse gas emissions for the purposes of addressing changes 19
in atmospheric temperature without specific legislative 20
authorization, including, but not limite d to: 21
(a) State plans developed pursuant to 42 U.S.C. s. 7402, 22
s. 7410, s. 7411, s. 7415, or s. 7545. 23
(b) Low carbon fuel standards. 24
(c) Plans or programs enabling regulation of mobile or 25

stationary sources, greenhouse gas taxes or fees, or greenhous e 26
gas trading. 27
(d) State or regional programs prompted by the 28
participation of the United States in international treaties or 29
executive agreements or interstate compacts or agreements. 30
Section 2. This act shall take effect July 1, 2022. 31
