16	16		creating ss. 125.488 and 166.0484, F.S.; prohibiting 3
17	17		counties and certain municipalities from enacting 4
18	18		ordinances, regulations, or policies that prevent 5
19	19		certain electric utilities from installing temporary 6
20	20		underground power panels and from requiring subsequent 7
21	21		inspections of such panels as a condition of a 8
22	22		Certificate of Occupancy under specified conditions ; 9
23	23		defining the term "temporary underground power panel"; 10
24	24		providing an effective date. 11

26	26		Be It Enacted by the Legislature of the State of Florida: 13

28	28		Section 1. Section 125.488, Florida Statutes, is created 15
29	29		to read: 16
30	30		125.488 Ordinances, regulations, a nd policies concerning 17
31	31		temporary underground power panels. — 18
32	32		(1) A county may not enact any ordinance, regulation, or 19
33	33		policy that prevents or has the effect of preventing an electric 20
34	34		utility, as defined in s. 366.02(2), from installing a temporary 21
35	35		underground power panel if the temporary underground power panel 22
36	36		meets the requirements of Article 590 of the National Electrical 23
37	37		Code, 2020 edition, during the construction and installation of 24
38	38		the temporary underground power panel. After the county has 25

52	52		panel, the county may not require a subsequent inspection of the 27
53	53		temporary underground power panel as a condition of issuance of 28
54	54		the Certificate of Occupancy. 29
55	55		(2) As used in this section, the term "tempor ary 30
56	56		underground power panel" means a permanent meter base that 31
57	57		includes a meter socket, meter, and downpipe, to which power is 32
58	58		provided through an underground service line by an electric 33
59	59		utility pursuant to its tariffs or service standards, that is 34
60	60		permanently attached to a block residential structure, provides 35
61	61		temporary power for construction of the residential structure, 36
62	62		and is intended for use in providing permanent service to the 37
63	63		residential structure upon issuance of the Certificate of 38
64	64		Occupancy. 39
65	65		Section 2. Section 166.0484, Florida Statutes, is created 40

91	91		power panel as a condition of issuance of the Certificate of 54

93	93		(2) As used in this section, the term "temporary 56

103	103		(3) Subsections (1) and (2) do not apply to a municipality 66
104	104		that owns or operates an electric utility with 100,000 customers 67
105	105		or less and the municipality's ordinance, regulation, or policy 68
106	106		applies only to its operations as an electric utility. 69
107	107		Section 3. This act shall take effect July 1, 2022. 70
