ENROLLED CS/HB 481, Engrossed 1 2022 Legislature CODING: Words stricken are deletions; words underlined are additions. hb0481-03-er Page 1 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S 1 An act relating to temporary underground power panels; 2 creating ss. 125.488 and 166.0484, F.S.; prohibiting 3 counties and certain municipalities from enacting 4 ordinances, regulations, or policies that prevent 5 certain electric utilities from installing temporary 6 underground power panels and from requiring subsequent 7 inspections of such panels as a condition of a 8 Certificate of Occupancy under specified conditions ; 9 defining the term "temporary underground power panel"; 10 providing an effective date. 11 12 Be It Enacted by the Legislature of the State of Florida: 13 14 Section 1. Section 125.488, Florida Statutes, is created 15 to read: 16 125.488 Ordinances, regulations, a nd policies concerning 17 temporary underground power panels. — 18 (1) A county may not enact any ordinance, regulation, or 19 policy that prevents or has the effect of preventing an electric 20 utility, as defined in s. 366.02(2), from installing a temporary 21 underground power panel if the temporary underground power panel 22 meets the requirements of Article 590 of the National Electrical 23 Code, 2020 edition, during the construction and installation of 24 the temporary underground power panel. After the county has 25 ENROLLED CS/HB 481, Engrossed 1 2022 Legislature CODING: Words stricken are deletions; words underlined are additions. hb0481-03-er Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S conducted an inspection of the temporary underground power 26 panel, the county may not require a subsequent inspection of the 27 temporary underground power panel as a condition of issuance of 28 the Certificate of Occupancy. 29 (2) As used in this section, the term "tempor ary 30 underground power panel" means a permanent meter base that 31 includes a meter socket, meter, and downpipe, to which power is 32 provided through an underground service line by an electric 33 utility pursuant to its tariffs or service standards, that is 34 permanently attached to a block residential structure, provides 35 temporary power for construction of the residential structure, 36 and is intended for use in providing permanent service to the 37 residential structure upon issuance of the Certificate of 38 Occupancy. 39 Section 2. After the municipality has conducted an inspection of the 51 temporary underground power panel, the municipality may not 52 require a subsequent inspection of the temporary undergroun d 53 power panel as a condition of issuance of the Certificate of 54 Occupancy. 55 (2) As used in this section, the term "temporary 56 underground power panel" means a permanent meter base that 57 includes a meter socket, meter, and downpipe, to which power is 58 provided through an underground service line by an electric 59 utility pursuant to its tariffs or service standards, that is 60 permanently attached to a block residential structure, provides 61 temporary power for construction of the residential structure, 62 and is intended for use in providing permanent service to the 63 residential structure upon issuance of the Certificate of 64 Occupancy. 65 (3) Subsections (1) and (2) do not apply to a municipality 66 that owns or operates an electric utility with 100,000 customers 67 or less and the municipality's ordinance, regulation, or policy 68 applies only to its operations as an electric utility. 69 Section 3. This act shall take effect July 1, 2022. 70
