1313 An act relating to Barefoot Bay Recreation District, 2
1414 Brevard County; authorizing an amendment to the 3
1515 district charter, subject to approval by a vote of the 4

2222 Be It Enacted by the Legislature of the State of Florida: 11

2424 Section 1. Notwithstanding s. 418.302(3), Florida 13
2525 Statutes, or any law to the contrary, the Brevard County 14
2626 Commission may amend the Charter of the Barefoot Bay Recreation 15
2727 District, subject to approval by a v ote of the electors of the 16
2828 district pursuant to s. 418.30, Florida Statutes, to increase 17
2929 the length of terms and stagger the election cycle for the 18
3030 members of the Board of Trustees of the Barefoot Bay Recreation 19
3131 District. If approved by the electors of the district voting in 20
3232 a referendum election in November 2022, the members of the board 21
3333 of trustees shall be elected as follows: 22
3434 (1) In the election held in November 2023, the candidate 23
3535 receiving the highest number of votes shall be elected to serve 24
3636 a term of 3 years and the candidate receiving the second highest 25

4747 number of votes shall be elected to serve a term of 2 years. 26
4848 (2) In the election held in November 2024, the candidates 27
4949 receiving the highest and second highest number of votes shall 28
5050 each be elected to serve a term of 3 years and the candidate 29
5151 receiving the third highest number of votes shall be elected to 30
5252 serve a term of 2 years. 31
5353 (3) In each subsequent election, candidates elected to 32
5454 serve as members of the board of trustees shall each be elected 33
5555 to serve a term of 3 years. 34
5656 Section 2. Notwithstanding s. 418.302(3), Florida 35
5757 Statutes, or any law to the contrary, if the referendum election 36
5858 referenced in section 1 of this act is approved by the electors 37
5959 of the district in the election of November 2022, the Board of 38
6060 County Commissioners of Brevard County shall amend the Charter 39
6161 of Barefoot Bay Recreation District to limit the number of terms 40
6262 of the members of the board of trustees of the district to no 41
6363 more than 3 successive complete 2 -year terms or 2 successive 42
6464 complete 3-year terms. A trustee may not serve more than 6 43
6565 consecutive years. Beginning with the election to be held in 44
6666 November 2023, if any potential candidate's election to a 3 -year 45
6767 term would result in the candidate serving as a trustee f or more 46
6868 than 6 consecutive years, the candidate may not be qualified for 47
6969 election to the board of trustees. A member of the board of 48
7070 trustees to whom this limitation applies may serve no sooner 49
7171 than 3 years after the expiration of the member's last 50

8282 successive complete term. This limitation shall not apply to the 51
8383 portion of any unexpired term served by appointment to fill a 52
8484 vacant seat pursuant to s. 418.302(5), Florida Statutes. If the 53
8585 referendum referenced in section 1 of this act is approved by 54
8686 the electors of the district in the election of November 2022, 55
8787 this section shall supersede and replace section 1 of chapter 56
8888 2017-202, Laws of Florida, otherwise section 1 of chapter 2017 -57
8989 202, Laws of Florida, shall remain in full force and effect. 58
9090 Section 3. This act shall take effect upon becoming a law. 59
