22 | 22 | | Be It Enacted by the Legislature of the State of Florida: 11 |

24 | 24 | | Section 1. Notwithstanding s. 418.302(3), Florida 13 |
---|
25 | 25 | | Statutes, or any law to the contrary, the Brevard County 14 |
---|
26 | 26 | | Commission may amend the Charter of the Barefoot Bay Recreation 15 |
---|
27 | 27 | | District, subject to approval by a v ote of the electors of the 16 |
---|
28 | 28 | | district pursuant to s. 418.30, Florida Statutes, to increase 17 |
---|
29 | 29 | | the length of terms and stagger the election cycle for the 18 |
---|
30 | 30 | | members of the Board of Trustees of the Barefoot Bay Recreation 19 |
---|
31 | 31 | | District. If approved by the electors of the district voting in 20 |
---|
32 | 32 | | a referendum election in November 2022, the members of the board 21 |
---|
33 | 33 | | of trustees shall be elected as follows: 22 |

34 | 34 | | (1) In the election held in November 2023, the candidate 23 |
---|
35 | 35 | | receiving the highest number of votes shall be elected to serve 24 |
---|
36 | 36 | | a term of 3 years and the candidate receiving the second highest 25 |

48 | 48 | | (2) In the election held in November 2024, the candidates 27 |

49 | 49 | | receiving the highest and second highest number of votes shall 28 |

50 | 50 | | each be elected to serve a term of 3 years and the candidate 29 |
---|
51 | 51 | | receiving the third highest number of votes shall be elected to 30 |

52 | 52 | | serve a term of 2 years. 31 |

53 | 53 | | (3) In each subsequent election, candidates elected to 32 |
---|
54 | 54 | | serve as members of the board of trustees shall each be elected 33 |
---|
55 | 55 | | to serve a term of 3 years. 34 |

56 | 56 | | Section 2. Notwithstanding s. 418.302(3), Florida 35 |
---|
57 | 57 | | Statutes, or any law to the contrary, if the referendum election 36 |
---|
58 | 58 | | referenced in section 1 of this act is approved by the electors 37 |
---|
59 | 59 | | of the district in the election of November 2022, the Board of 38 |
---|
60 | 60 | | County Commissioners of Brevard County shall amend the Charter 39 |
---|
61 | 61 | | of Barefoot Bay Recreation District to limit the number of terms 40 |
---|
62 | 62 | | of the members of the board of trustees of the district to no 41 |
---|
63 | 63 | | more than 3 successive complete 2 -year terms or 2 successive 42 |
---|
64 | 64 | | complete 3-year terms. A trustee may not serve more than 6 43 |
---|
65 | 65 | | consecutive years. Beginning with the election to be held in 44 |
---|
66 | 66 | | November 2023, if any potential candidate's election to a 3 -year 45 |
---|
67 | 67 | | term would result in the candidate serving as a trustee f or more 46 |
---|
68 | 68 | | than 6 consecutive years, the candidate may not be qualified for 47 |
---|
69 | 69 | | election to the board of trustees. A member of the board of 48 |
---|
70 | 70 | | trustees to whom this limitation applies may serve no sooner 49 |
---|

85 | 85 | | referendum referenced in section 1 of this act is approved by 54 |

86 | 86 | | the electors of the district in the election of November 2022, 55 |

87 | 87 | | this section shall supersede and replace section 1 of chapter 56 |
---|
88 | 88 | | 2017-202, Laws of Florida, otherwise section 1 of chapter 2017 -57 |

89 | 89 | | 202, Laws of Florida, shall remain in full force and effect. 58 |
---|
90 | 90 | | Section 3. This act shall take effect upon becoming a law. 59 |
