An act relating to Barefoot Bay Recreation District, 2 
Brevard County; authorizing an amendment to the 3 
district charter, subject to approval by a vote of the 4 
electors of the district, to increase the length of 5 
terms and stagger the election cycle for the members 6 
of the Board of Trustees of the Barefoot Bay 7 
Recreation District; providing exceptions to general 8 
law; providing an effective date. 9 
 10 
Be It Enacted by the Legislature of the State of Florida: 11 
 12 
 Section 1.  Notwithstanding s. 418.302(3), Florida 13 
Statutes, or any law to the contrary, the Brevard County 14 
Commission may amend the Charter of the Barefoot Bay Recreation 15 
District, subject to approval by a v ote of the electors of the 16 
district pursuant to s. 418.30, Florida Statutes, to increase 17 
the length of terms and stagger the election cycle for the 18 
members of the Board of Trustees of the Barefoot Bay Recreation 19 
District. If approved by the electors of the district voting in 20 
a referendum election in November 2022, the members of the board 21 
of trustees shall be elected as follows: 22 
 (1)  In the election held in November 2023, the candidate 23 
receiving the highest number of votes shall be elected to serve 24 
a term of 3 years and the candidate receiving the second highest 25

number of votes shall be elected to serve a term of 2 years. 26 
 (2)  In the election held in November 2024, the candidates 27 
receiving the highest and second highest number of votes shall 28 
each be elected to serve a term of 3 years and the candidate 29 
receiving the third highest number of votes shall be elected to 30 
serve a term of 2 years. 31 
 (3)  In each subsequent election, candidates elected to 32 
serve as members of the board of trustees shall each be elected 33 
to serve a term of 3 years. 34 
 Section 2.  Notwithstanding s. 418.302(3), Florida 35 
Statutes, or any law to the contrary, if the referendum election 36 
referenced in section 1 of this act is approved by the electors 37 
of the district in the election of November 2022, the Board of 38 
County Commissioners of Brevard County shall amend the Charter 39 
of Barefoot Bay Recreation District to limit the number of terms 40 
of the members of the board of trustees of the district to no 41 
more than 3 successive complete 2 -year terms or 2 successive 42 
complete 3-year terms. A trustee may not serve more than 6 43 
consecutive years. Beginning with the election to be held in 44 
November 2023, if any potential candidate's election to a 3 -year 45 
term would result in the candidate serving as a trustee f or more 46 
than 6 consecutive years, the candidate may not be qualified for 47 
election to the board of trustees. A member of the board of 48 
trustees to whom this limitation applies may serve no sooner 49 
than 3 years after the expiration of the member's last 50

successive complete term. This limitation shall not apply to the 51 
portion of any unexpired term served by appointment to fill a 52 
vacant seat pursuant to s. 418.302(5), Florida Statutes. If the 53 
referendum referenced in section 1 of this act is approved by 54 
the electors of the district in the election of November 2022, 55 
this section shall supersede and replace section 1 of chapter 56 
2017-202, Laws of Florida, otherwise section 1 of chapter 2017 -57 
202, Laws of Florida, shall remain in full force and effect. 58 
 Section 3.  This act shall take effect upon becoming a law. 59
