18	18	WHEREAS, the Leahy-Smith America Invents Act, H.R. 1249, 6
19	19	was passed by Congress and signed into law on September 16, 7
20	20	2011, and 8
21	21	WHEREAS, the Leahy-Smith America Invents Act represents a 9
22	22	negative legislative change to the United States patent system, 10
23	23	and 11
24	24	WHEREAS, the Leahy-Smith America Invents A ct negatively 12
25	25	transformed the United States patent system from a "first to 13
26	26	invent" system to a "first inventor to file" system, eliminated 14
27	27	interference proceedings, and developed post -grant opposition, 15
28	28	and 16
29	29	WHEREAS, every day that Congress is in session th ere are 17
30	30	lobbyists trying to weaken the patent system, and 18
31	31	WHEREAS, the Leahy-Smith America Invents Act is not about 19
32	32	strengthening the patent granting system but about making it 20
33	33	harder for patent owners to assert patents to protect their 21
34	34	rights, and 22
35	35	WHEREAS, patents help the "little guy" so a one -person 23
36	36	company and a company with 10,000 employees each have the same 24 

51	51	constitutionality and only helps big corporations, destroying 28

53	53	WHEREAS, the United States patent system should revert to 30
54	54	the fair system that was in place before the passage of the 31
55	55	Leahy-Smith America Invents Act , NOW, THEREFORE, 32

57	57	Be It Resolved by the Legislature of the State of Florida: 34

59	59	That Congress is urged to repeal the Leahy -Smith America 36
60	60	Invents Act of 2011. 37
61	61	BE IT FURTHER RESOLVED that copies of this memorial be 38
62	62	dispatched to the President of the Uni ted States, to the 39
63	63	President of the United States Senate, to the Speaker of the 40
64	64	United States House of Representatives, and to each member of 41
65	65	the Florida delegation to the United States Congress. 42
