urging Congress to repeal the Leahy -Smith America 3
Invents Act of 2011. 4

WHEREAS, the Leahy-Smith America Invents Act, H.R. 1249, 6
was passed by Congress and signed into law on September 16, 7
2011, and 8
WHEREAS, the Leahy-Smith America Invents Act represents a 9
negative legislative change to the United States patent system, 10
and 11
WHEREAS, the Leahy-Smith America Invents A ct negatively 12
transformed the United States patent system from a "first to 13
invent" system to a "first inventor to file" system, eliminated 14
interference proceedings, and developed post -grant opposition, 15
and 16
WHEREAS, every day that Congress is in session th ere are 17
lobbyists trying to weaken the patent system, and 18
WHEREAS, the Leahy-Smith America Invents Act is not about 19
strengthening the patent granting system but about making it 20
harder for patent owners to assert patents to protect their 21
rights, and 22
WHEREAS, patents help the "little guy" so a one -person 23
company and a company with 10,000 employees each have the same 24

rights, a fact that may be considered repulsive to the company 25
with 10,000 employees, and 26
WHEREAS, the Leahy-Smith America Invents Act is of d ubious 27
constitutionality and only helps big corporations, destroying 28
the power of the small inventor, and 29
WHEREAS, the United States patent system should revert to 30
the fair system that was in place before the passage of the 31
Leahy-Smith America Invents Act , NOW, THEREFORE, 32

Be It Resolved by the Legislature of the State of Florida: 34

That Congress is urged to repeal the Leahy -Smith America 36
Invents Act of 2011. 37
BE IT FURTHER RESOLVED that copies of this memorial be 38
dispatched to the President of the Uni ted States, to the 39
President of the United States Senate, to the Speaker of the 40
United States House of Representatives, and to each member of 41
the Florida delegation to the United States Congress. 42
