19	19	shops are exempt from providing certain estimates and 6
20	20	disclosures to customers; amending s. 559.909, F.S.; 7
21	21	conforming a cross-reference; providing an effective 8
22	22	date. 9

24	24	Be It Enacted by the Legislature of the Stat e of Florida: 11

26	26	Section 1. Subsections (6), (7), and (8) of section 13
27	27	559.903, Florida Statutes, are renumbered as subsections (7), 14
28	28	(8), and (6), respectively, and subsection (9) is added to that 15
29	29	section to read: 16
30	30	559.903 Definitions. —As used in this act: 17
31	31	(9) "Tire services" means the retail sale of tires and 18
32	32	wheels and the parts, accessories, and services related to the 19
33	33	installation and repair of tires and wheels. 20
34	34	Section 2. Subsections (4), (5), and (6) of section 21
35	35	559.905, Florida Statutes, are re numbered as subsections (5), 22
36	36	(6), and (7), respectively, and a new subsection (4) is added to 23
37	37	that section to read: 24

52	52	(4) A motor vehicle repair shop that engages in tire 27
53	53	services does not need to provide the information required by 28
54	54	paragraphs (1)(h) and (i) and subsection (2) to a customer if 29
55	55	the customer is provided with a detailed sales invoice setting 30
56	56	forth the cost of all tire -related and wheel-related goods and 31
57	57	services and the customer pays the invoice before work is begun. 32
58	58	Section 3. Paragraph (c) of subsection (1) of section 33
59	59	559.909, Florida Statutes, is amended to read: 34
60	60	559.909 Notification of charges in excess of repair 35
61	61	estimate; unlawful charges; refusal to return vehicle 36
62	62	prohibited; inspection of parts. — 37
63	63	(1) In the event that: 38
64	64	(c) An implied partial waiver exists for diagnostic work, 39
65	65	as described in s. 559.905(6) s. 559.905(5), and such diagnostic 40
66	66	work has been completed, 41

68	68	the customer shall be promptly notified by telephone, telegraph, 43
69	69	mail, or other means of the additional repair work and estimated 44
70	70	cost thereof. A customer so notified shall, orally or in 45
71	71	writing, authorize, modify, or cancel the order for repair. 46
72	72	Section 4. This act shall take effect July 1, 2022. 47
