19	19	respectively, take effect by a specified period upon 6
20	20	approval by certain entities; providing an effective 7

23	23	Be It Enacted by the Legislature of the State of Florida: 10

25	25	Section 1. Paragraph (e) of subsection (7) of section 12
26	26	553.73, Florida Statutes, is amended to read: 13
27	27	553.73 Florida Building Code. — 14

29	29	(e) A rule updating the Florida Building Code in 16
30	30	accordance with this subsection shall take effect no sooner than 17
31	31	6 months after the latest occurrence of the publication of the 18
32	32	updated Florida Building Code, approval by the commission of 19
33	33	energy code compliance software, or the publication of the 20
34	34	updated Florida Fire Prevention Code pursuant to s. 633.202 . Any 21
35	35	amendment to the Florida Building Code which is adopted upon a 22
36	36	finding by the commission that the amendment is necessary to 23
37	37	protect the public from immediate threat of harm takes effect 24

51	51	Section 2. Subsection (4) of section 633.202, Florida 26
52	52	Statutes, is amended to read: 27
53	53	633.202 Florida Fire Prevention Code. — 28
54	54	(4) The State Fire Marshal shall update, by rule adopted 29
55	55	pursuant to ss. 120.536(1) and 120.54, the Florida Fire 30
56	56	Prevention Code every 3 years. Once initially adopted and 31
57	57	subsequently updated, the Florida Fire Prevention Code shall be 32
58	58	adopted for use statewide without adoptions by local governments 33
59	59	and shall take effect no sooner than 6 months after the latest 34
60	60	occurrence of the publication of the updated Florida Building 35
61	61	Code pursuant to s. 553.73, approval by the Florida Building 36
62	62	Commission of energy code compliance software, or the 37
63	63	publication of the updated Florida Fire Prevention Code . When 38
64	64	updating the Florida Fire Prevention Code, the State Fire 39
65	65	Marshal shall consider changes made by the national model fire 40
66	66	codes incorporated into the Florida Fire Prevention Code, the 41
67	67	State Fire Marshal's own interpretations, declaratory 42
68	68	statements, appellate decisions, and approved statewide and 43
69	69	local technical amendments. 44
70	70	Section 3. This act shall take effect July 1, 2022. 45
