A bill to be entitled 1 
An act relating to Florida Building Code and Florida 2 
Fire Prevention Code rules; amending ss. 553.73 and 3 
633.202, F.S.; providing that updates to the Florida 4 
Building Code and Florida Fire Prevention Code, 5 
respectively, take effect by a specified period upon 6 
approval by certain entities; providing an effective 7 
date. 8

Be It Enacted by the Legislature of the State of Florida: 10 
 11 
 Section 1.  Paragraph (e) of subsection (7) of section 12 
553.73, Florida Statutes, is amended to read: 13 
 553.73  Florida Building Code. — 14 
 (7) 15 
 (e)  A rule updating the Florida Building Code in 16 
accordance with this subsection shall take effect no sooner than 17 
6 months after the latest occurrence of the publication of the 18 
updated Florida Building Code, approval by the commission of 19 
energy code compliance software, or the publication of the 20 
updated Florida Fire Prevention Code pursuant to s. 633.202 . Any 21 
amendment to the Florida Building Code which is adopted upon a 22 
finding by the commission that the amendment is necessary to 23 
protect the public from immediate threat of harm takes effect 24 
immediately. 25

 Section 2.  Subsection (4) of section 633.202, Florida 26 
Statutes, is amended to read: 27 
 633.202  Florida Fire Prevention Code. — 28 
 (4)  The State Fire Marshal shall update, by rule adopted 29 
pursuant to ss. 120.536(1) and 120.54, the Florida Fire 30 
Prevention Code every 3 years. Once initially adopted and 31 
subsequently updated, the Florida Fire Prevention Code shall be 32 
adopted for use statewide without adoptions by local governments 33 
and shall take effect no sooner than 6 months after the latest 34 
occurrence of the publication of the updated Florida Building 35 
Code pursuant to s. 553.73, approval by the Florida Building 36 
Commission of energy code compliance software, or the 37 
publication of the updated Florida Fire Prevention Code . When 38 
updating the Florida Fire Prevention Code, the State Fire 39 
Marshal shall consider changes made by the national model fire 40 
codes incorporated into the Florida Fire Prevention Code, the 41 
State Fire Marshal's own interpretations, declaratory 42 
statements, appellate decisions, and approved statewide and 43 
local technical amendments. 44 
 Section 3.  This act shall take effect July 1, 2022. 45
