2828 Section 1. Section 409.9141, Florida Statutes, is created 15

3232 (1)(a) The agency shall establish and , subject to federal 19
3333 approval through a waiver or state plan amendment, implement a 20
3434 Medicaid buy-in program, authorized under the federal Ticket to 21
3535 Work and Work Incentives Improvement Act of 1999, Pub. L. No. 22
3636 106-170, and the federal Balanced Budget Act of 1997, Pub. L. 23
3737 No. 105-33, for individuals with disabilities who are between 16 24
3838 and 64 years of age and whose incomes exceed the maximum income 25

5151 eligibility level for initial enrollment to obtain coverage for 26
5252 medical assistance under the Medicaid program. 27
5353 (b) The Medicaid buy -in program must provide full Medicaid 28
5454 benefits to eligible individuals and must limit any premiums or 29
5555 cost sharing to a certain percentage o f an individual's income, 30
5656 as determined by the agency. 31
5757 (2) By October 1, 2022, the agency shall seek federal 32
5858 waiver approval or submit any state plan amendments necessary to 33
5959 implement the Medicaid buy -in program under this section. The 34
6060 agency shall implement the program upon receiving federal 35
6161 approval. 36
6262 Section 2. This act shall take effect upon becoming a law. 37
