A bill to be entitled 1 
An act relating to a Medicaid buy -in program; creating 2 
s. 409.9141, F.S.; requiring the Agency for Health 3 
Care Administration to establish and implement a 4 
Medicaid buy-in program for certain individuals with 5 
disabilities; providing requirements for the program; 6 
requiring the agency to seek federal waiver approval 7 
or submit any state plan amendments necessary to 8 
implement the program by a specified date; requ iring 9 
the agency to implement the program upon receiving 10 
federal approval; providing an effective date. 11

Be It Enacted by the Legislature of the State of Florida: 13 
 14 
 Section 1.  Section 409.9141, Florida Statutes, is created 15 
to read: 16 
 409.9141  Medicaid buy-in program for individuals with 17 
disabilities.— 18 
 (1)(a)  The agency shall establish and , subject to federal 19 
approval through a waiver or state plan amendment, implement a 20 
Medicaid buy-in program, authorized under the federal Ticket to 21 
Work and Work Incentives Improvement Act of 1999, Pub. L. No. 22 
106-170, and the federal Balanced Budget Act of 1997, Pub. L. 23 
No. 105-33, for individuals with disabilities who are between 16 24 
and 64 years of age and whose incomes exceed the maximum income 25

eligibility level for initial enrollment to obtain coverage for 26 
medical assistance under the Medicaid program. 27 
 (b)  The Medicaid buy -in program must provide full Medicaid 28 
benefits to eligible individuals and must limit any premiums or 29 
cost sharing to a certain percentage o f an individual's income, 30 
as determined by the agency. 31 
 (2)  By October 1, 2022, the agency shall seek federal 32 
waiver approval or submit any state plan amendments necessary to 33 
implement the Medicaid buy -in program under this section. The 34 
agency shall implement the program upon receiving federal 35 
approval. 36 
 Section 2.  This act shall take effect upon becoming a law. 37
