25	25	Be It Enacted by the Legislature of the State of Florida: 12
26	26	13
27	27	Section 1. Subsection (1) of section 570.85, Florida 14
28	28	Statutes, is amended to read: 15
29	29	570.85 Agritourism. — 16
30	30	(1) It is the intent of the Legislature to promote 17
31	31	agritourism as a way to support bona fide agricultural 18
32	32	production by providing a secondary stream of revenue and by 19
33	33	educating the general public about the agricultural industry. It 20
34	34	is also the intent of the Legislature to eliminate duplication 21
35	35	of regulatory authority over agritourism as expressed in this 22
36	36	section. Except as otherwise provided for in this section, and 23
37	37	notwithstanding any other provision of law, a local government 24
38	38	may not adopt or enforce a local ordinance, regulation, rule, or 25

51	51	policy that prohibits, restrict s, regulates, or otherwise limits 26
52	52	an agritourism activity on land classified as agricultural land 27
53	53	under s. 193.461. This subsection does not limit the powers and 28
54	54	duties of a local government to address substantial offsite 29
55	55	impacts of agritourism activities or an emergency as provided in 30
56	56	chapter 252. 31
57	57	Section 2. Subsection (1) of section 570.87, Florida 32
58	58	Statutes, is amended to read: 33
59	59	570.87 Agritourism participation impact on land 34
60	60	classification.— 35
61	61	(1) In order to promote and perpetuate agriculture 36
62	62	throughout this the state, farm operations are encouraged to 37
63	63	engage in agritourism. An agricultural classification pursuant 38
64	64	to s. 193.461 may not be denied or revoked solely due to the 39
65	65	conduct of agritourism activity on a bona fide farm or the 40
66	66	construction, alteration, or maintenance of a nonresidential 41
67	67	farm building, structure, or facility on a bona fide farm which 42
68	68	is used to conduct agritourism activities. So long as the 43
69	69	building, structure, or facility is an integral part of the 44
70	70	agricultural operation, the la nd it occupies shall be considered 45
71	71	agricultural in nature. However, such buildings, structures, and 46
72	72	facilities, and other improvements on the land, must be assessed 47
73	73	under s. 193.011 at their just value and added to the 48
74	74	agriculturally assessed value of the land on agricultural lands 49
75	75	classified as such pursuant to s. 193.461 does not limit, 50

89	89	such lands classified as agricultural remain used primarily for 52
90	90	bona fide agricultural purposes . 53
91	91	Section 3. This act shall take effect July 1, 2022. 54
