2525 Be It Enacted by the Legislature of the State of Florida: 12

2727 Section 1. Subsection (1) of section 570.85, Florida 14
2828 Statutes, is amended to read: 15
2929 570.85 Agritourism. — 16
3030 (1) It is the intent of the Legislature to promote 17
3131 agritourism as a way to support bona fide agricultural 18
3232 production by providing a secondary stream of revenue and by 19
3333 educating the general public about the agricultural industry. It 20
3434 is also the intent of the Legislature to eliminate duplication 21
3535 of regulatory authority over agritourism as expressed in this 22
3636 section. Except as otherwise provided for in this section, and 23
3737 notwithstanding any other provision of law, a local government 24
3838 may not adopt or enforce a local ordinance, regulation, rule, or 25

5151 policy that prohibits, restrict s, regulates, or otherwise limits 26
5252 an agritourism activity on land classified as agricultural land 27
5353 under s. 193.461. This subsection does not limit the powers and 28
5454 duties of a local government to address substantial offsite 29
5555 impacts of agritourism activities or an emergency as provided in 30
5656 chapter 252. 31
5757 Section 2. Subsection (1) of section 570.87, Florida 32
5858 Statutes, is amended to read: 33
5959 570.87 Agritourism participation impact on land 34
6060 classification.— 35
6161 (1) In order to promote and perpetuate agriculture 36
6262 throughout this the state, farm operations are encouraged to 37
6363 engage in agritourism. An agricultural classification pursuant 38
6464 to s. 193.461 may not be denied or revoked solely due to the 39
6565 conduct of agritourism activity on a bona fide farm or the 40
6666 construction, alteration, or maintenance of a nonresidential 41
6767 farm building, structure, or facility on a bona fide farm which 42
6868 is used to conduct agritourism activities. So long as the 43
6969 building, structure, or facility is an integral part of the 44
7070 agricultural operation, the la nd it occupies shall be considered 45
7171 agricultural in nature. However, such buildings, structures, and 46
7272 facilities, and other improvements on the land, must be assessed 47
7373 under s. 193.011 at their just value and added to the 48
7474 agriculturally assessed value of the land on agricultural lands 49
