5151 (a) "Board" means the Board of Pharmacy. 26
5252 (b) "Department" means the Department of Health. 27
5353 (c) "Nonretrievable" has the same meaning as in 21 C.F.R. 28
5454 s. 1300.05(b), as that definition exists on the effective date 29

5656 (d) "Pharmacy" has the same meaning as in s. 465.003( 11). 31
5757 (e) "Program" means the At -home Drug Deactivation and 32
5858 Disposal System Program. 33
5959 (2) PROGRAM ESTABLISHED. — 34
6060 (a) The department, in coordination with the board, shall 35
6161 establish and administer the At -home Drug Deactivation and 36
6262 Disposal System Program for the purpose of identifying and 37
6363 distributing to pharmacies an at -home drug deactivation and 38
6464 disposal system that is suitable for the safe disposal of opioid 39
6565 drugs prescribed for the treatment of acute pain pursuant to s. 40
6666 456.44(5). The at-home drug deactivation and disposal system 41
6767 must be capable of permanently rendering the active 42
6868 pharmaceutical ingredient in such prescriptions nonretrievable, 43
6969 nonusable, and environmentally safe for disposal. Pharmacies 44
7070 must co-dispense the at-home drug deactivation an d disposal 45
7171 system with each opioid prescription dispensed for the treatment 46
7272 of acute pain pursuant to s. 456.44(5). 47
7373 (b) The department, in coordination with the board, shall 48
7474 develop relevant educational materials and a plan for 49

8989 (3) RULEMAKING AUTHORITY. —The department, in consultation 52
