A bill to be entitled 1 
An act relating to at -home drug deactivation and 2 
disposal systems; creating s. 381.888, F.S.; providing 3 
definitions; requiring the Department of Health, in 4 
coordination with the Board of Pharmacy, to establish 5 
and administer the At -home Drug Deactivation and 6 
Disposal System Program for a specified purpose; 7 
providing requirements for at-home drug deactivation 8 
and disposal systems; requiring pharmacies to co -9 
dispense such systems with each opioid prescription 10 
for the treatment of acute pain; requiring the 11 
department, in coordination with the board, to develop 12 
relevant educational materials and a plan for 13 
distribution of the at -home drug deactivation and 14 
disposal systems and educational materials; requiring 15 
the department, in consultation with the board, to 16 
adopt rules; providing an effective date. 17

Be It Enacted by the L egislature of the State of Florida: 19 
 20 
 Section 1.  Section 381.888, Florida Statutes, is created 21 
to read: 22 
 381.888  At-home Drug Deactivation and Disposal System 23 
Program.— 24 
 (1)  DEFINITIONS.—As used in this section, the term: 25

 (a)  "Board" means the Board of Pharmacy. 26 
 (b)  "Department" means the Department of Health. 27 
 (c)  "Nonretrievable" has the same meaning as in 21 C.F.R. 28 
s. 1300.05(b), as that definition exists on the effective date 29 
of this act. 30 
 (d)  "Pharmacy" has the same meaning as in s. 465.003( 11). 31 
 (e)  "Program" means the At -home Drug Deactivation and 32 
Disposal System Program. 33 
 (2)  PROGRAM ESTABLISHED. — 34 
 (a)  The department, in coordination with the board, shall 35 
establish and administer the At -home Drug Deactivation and 36 
Disposal System Program for the purpose of identifying and 37 
distributing to pharmacies an at -home drug deactivation and 38 
disposal system that is suitable for the safe disposal of opioid 39 
drugs prescribed for the treatment of acute pain pursuant to s. 40 
456.44(5). The at-home drug deactivation and disposal system 41 
must be capable of permanently rendering the active 42 
pharmaceutical ingredient in such prescriptions nonretrievable, 43 
nonusable, and environmentally safe for disposal. Pharmacies 44 
must co-dispense the at-home drug deactivation an d disposal 45 
system with each opioid prescription dispensed for the treatment 46 
of acute pain pursuant to s. 456.44(5). 47 
 (b)  The department, in coordination with the board, shall 48 
develop relevant educational materials and a plan for 49 
distribution of the at -home drug deactivation and disposal 50

systems and educational materials to pharmacies in this state. 51 
 (3)  RULEMAKING AUTHORITY. —The department, in consultation 52 
with the board, shall adopt rules to administer the program. 53 
 Section 2.  This act shall take effect July 1, 2022. 54
