CS/HB 877 2022 CODING: Words stricken are deletions; words underlined are additions. hb0877-01-c1 Page 1 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to the Downtown Development Authority 2 of the City of Fort Lauderdale, Broward County; 3 amending chapter 2005 -346, Laws of Florida; revising a 4 specified expiration date; providing for the transfer 5 of assets from the Downtown Development Authority to 6 the City of Fort Lauderdale upon the date of 7 dissolution of the authority; requiring a referendum; 8 providing effective dates. 9 10 WHEREAS, the Downtown Development Authority of the City of 11 Fort Lauderdale (DDA) was created by special act of the 12 Legislature in 1965, and 13 WHEREAS, the DDA has been the driving force in the growth 14 and progress of Downtown Fort Lauderdale for the past five 15 decades, and 16 WHEREAS, the DDA has dedicated land and resources for such 17 public amenities including the Broward Performing Arts Center, 18 the Downtown Library, Museum of Science, and Huizenga Plaza 19 Park, among many others, and 20 WHEREAS, the DDA has been active in providin g input and 21 solutions for such important ongoing issues such as 22 transportation, affordable housing, community safety, and parks 23 and public space improvements, and 24 CS/HB 877 2022 CODING: Words stricken are deletions; words underlined are additions. hb0877-01-c1 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S WHEREAS, the DDA is an important vehicle for representation 25 and participation of the commerc ial property owners in Downtown 26 Fort Lauderdale. 27 28 Be It Enacted by the Legislature of the State of Florida: 29 30 Section 1. Section 15 of section 3 of chapter 2005 -346, 31 Laws of Florida, is amended to read: 32 Section 15. On December 31, 2032 2030, this law shall 33 expire and all assets of the authority shall on or before that 34 date be transferred by the authority to the city. Any assets 35 remaining in the hands of the authority on December 31, 2032 36 2030, shall automatically devolve upon and become the propert y 37 of the city. In the event there shall be any indebtedness 38 outstanding against the authority, the city may continue to levy 39 whatever portion shall be necessary of the tax authorized by 40 this law to retire such indebtedness. 41 Section 2. Referendum.—Notwithstanding the requirement for 42 a board resolution in subsection (1) of section 18 of section 3 43 of chapter 2005-346, Laws of Florida, the board by resolution 44 shall call for a referendum of the authorized voters to be 45 conducted no later than 3 months after t he effective date of 46 this act. The referendum shall comply with the requirements of 47 section 18 of section 3 of chapter 2005 -346, Laws of Florida. 48 The referendum question shall be in substantially the following 49 CS/HB 877 2022 CODING: Words stricken are deletions; words underlined are additions. hb0877-01-c1 Page 3 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S form: 50 Extension of dissolution date for the Fo rt Lauderdale 51 Downtown Development Authority. 52 Shall section 15 of section 3 of chapter 2005 -346, 53 Laws of Florida, be amended to provide the dissolution 54 date for the Fort Lauderdale Downtown Development 55 District is extended from December 31, 2030, to 56 December 31, 2032? 57 ( ) YES. 58 ( ) NO. 59 Section 3. This act shall take effect only upon approval 60 by a majority vote of the landowners within the boundaries of 61 the Downtown Development Authority of the City of Fort 62 Lauderdale at a referendum to be held no later than 3 months 63 after the effective date of this act, except that section 2 and 64 this section shall take effect upon becoming a law. 65
