21	21	Be It Enacted by the Legislature of the State of Florida: 8

23	23	Section 1. Subsection (2) of section 1012.01, Florida 10
24	24	Statutes, is amended to read: 11
25	25	1012.01 Definitions. —As used in this chapter , the 12
26	26	following terms have the following meanings: 13
27	27	(2) INSTRUCTIONAL PERSONNEL. —"Instructional personnel" 14
28	28	means certified prekindergarten staff members funded in the 15
29	29	Florida Education Finance Program and any K-12 staff member 16
30	30	whose function includes the provision of direct instructional 17
31	31	services to students. Instructional personnel also includes K -12 18
32	32	personnel whose functions provide direct support in the learning 19
33	33	process of students. Included in the classification of 20
34	34	instructional personnel are the follo wing prekindergarten 21
35	35	through grade 12 K-12 personnel: 22
36	36	(a) Classroom teachers. —Classroom teachers are staff 23
37	37	members assigned the professional activity of instructing 24
38	38	students in courses in classroom situations, including basic 25

51	51	instruction, exceptional stu dent education, career education, 26
52	52	and adult education, including substitute teachers. Included in 27
53	53	this classification are prekindergarten instructors funded in 28
54	54	the Florida Education Finance Program who hold an educator 29
55	55	certificate in Prekindergarten/Primar y Education, Preschool 30
56	56	Education, Early Childhood Education, or any exceptional student 31
57	57	education area with the Prekindergarten Disabilities 32
58	58	endorsement. 33
59	59	(b) Student personnel services. —Student personnel services 34
60	60	include staff members responsible for: ad vising students with 35
61	61	regard to their abilities and aptitudes, educational and 36
62	62	occupational opportunities, and personal and social adjustments; 37
63	63	providing placement services; performing educational 38
64	64	evaluations; and similar functions. Included in this 39
65	65	classification are certified school counselors, social workers, 40
66	66	career specialists, and school psychologists. 41
67	67	(c) Librarians/media specialists. —Librarians/media 42
68	68	specialists are staff members responsible for providing school 43
69	69	library media services. These employe es are responsible for 44
70	70	evaluating, selecting, organizing, and managing media and 45
71	71	technology resources, equipment, and related systems; 46
72	72	facilitating access to information resources beyond the school; 47
73	73	working with teachers to make resources available in the 48
74	74	instructional programs; assisting teachers and students in media 49
75	75	productions; and instructing students in the location and use of 50

89	89	(d) Other instructional staff. —Other instructional staff 52
90	90	are staff members who are part of the instru ctional staff but 53
91	91	are not classified in one of the categories specified in 54
92	92	paragraphs (a)-(c). Included in this classification are primary 55
93	93	specialists, learning resource specialists, instructional 56
94	94	trainers, adjunct educators certified pursuant to s. 1012.5 7, 57
95	95	and similar positions. 58
96	96	(e) Education paraprofessionals. —Education 59
97	97	paraprofessionals are individuals who are under the direct 60
98	98	supervision of an instructional staff member, aiding the 61
99	99	instructional process. Included in this classification are 62
100	100	classroom paraprofessionals in regular instruction, exceptional 63
101	101	education paraprofessionals, career education paraprofessionals, 64
102	102	adult education paraprofessionals, library paraprofessionals, 65
103	103	physical education and playground paraprofessionals, and other 66
104	104	school-level paraprofessionals. 67
105	105	Section 2. This act shall take effect July 1, 2022. 68
