2323 Section 1. Subsection (2) of section 1012.01, Florida 10
2424 Statutes, is amended to read: 11
2525 1012.01 Definitions. —As used in this chapter , the 12
2626 following terms have the following meanings: 13
2727 (2) INSTRUCTIONAL PERSONNEL. —"Instructional personnel" 14
2828 means certified prekindergarten staff members funded in the 15
2929 Florida Education Finance Program and any K-12 staff member 16
3030 whose function includes the provision of direct instructional 17
3131 services to students. Instructional personnel also includes K -12 18
3232 personnel whose functions provide direct support in the learning 19
3333 process of students. Included in the classification of 20
3434 instructional personnel are the follo wing prekindergarten 21
3535 through grade 12 K-12 personnel: 22
3636 (a) Classroom teachers. —Classroom teachers are staff 23
3737 members assigned the professional activity of instructing 24
3838 students in courses in classroom situations, including basic 25

5252 and adult education, including substitute teachers. Included in 27
5353 this classification are prekindergarten instructors funded in 28
5454 the Florida Education Finance Program who hold an educator 29
5555 certificate in Prekindergarten/Primar y Education, Preschool 30
5656 Education, Early Childhood Education, or any exceptional student 31
5757 education area with the Prekindergarten Disabilities 32
5858 endorsement. 33
5959 (b) Student personnel services. —Student personnel services 34
6060 include staff members responsible for: ad vising students with 35
6161 regard to their abilities and aptitudes, educational and 36
6262 occupational opportunities, and personal and social adjustments; 37
6363 providing placement services; performing educational 38
6464 evaluations; and similar functions. Included in this 39
6565 classification are certified school counselors, social workers, 40
6666 career specialists, and school psychologists. 41
6767 (c) Librarians/media specialists. —Librarians/media 42
6868 specialists are staff members responsible for providing school 43
6969 library media services. These employe es are responsible for 44
7070 evaluating, selecting, organizing, and managing media and 45
7171 technology resources, equipment, and related systems; 46
7272 facilitating access to information resources beyond the school; 47
7373 working with teachers to make resources available in the 48
7474 instructional programs; assisting teachers and students in media 49

8989 (d) Other instructional staff. —Other instructional staff 52
9090 are staff members who are part of the instru ctional staff but 53
9191 are not classified in one of the categories specified in 54
9292 paragraphs (a)-(c). Included in this classification are primary 55
9393 specialists, learning resource specialists, instructional 56
9494 trainers, adjunct educators certified pursuant to s. 1012.5 7, 57
9595 and similar positions. 58
9696 (e) Education paraprofessionals. —Education 59
9797 paraprofessionals are individuals who are under the direct 60
9898 supervision of an instructional staff member, aiding the 61
9999 instructional process. Included in this classification are 62
100100 classroom paraprofessionals in regular instruction, exceptional 63
101101 education paraprofessionals, career education paraprofessionals, 64
102102 adult education paraprofessionals, library paraprofessionals, 65
103103 physical education and playground paraprofessionals, and other 66
104104 school-level paraprofessionals. 67
105105 Section 2. This act shall take effect July 1, 2022. 68
