Subsection (2) of section 1012.01, Florida 10 Statutes, is amended to read: 11 1012.01 Definitions. —As used in this chapter , the 12 following terms have the following meanings: 13 (2) INSTRUCTIONAL PERSONNEL. —"Instructional personnel" 14 means certified prekindergarten staff members funded in the 15 Florida Education Finance Program and any K-12 staff member 16 whose function includes the provision of direct instructional 17 services to students. Instructional personnel also includes K -12 18 personnel whose functions provide direct support in the learning 19 process of students. Included in the classification of 20 instructional personnel are the follo wing prekindergarten 21 through grade 12 K-12 personnel: 22 (a) Classroom teachers. —Classroom teachers are staff 23 members assigned the professional activity of instructing 24 students in courses in classroom situations, including basic 25 HB 1219 2022 CODING: Words stricken are deletions; words underlined are additions. hb1219-00 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S instruction, exceptional stu dent education, career education, 26 and adult education, including substitute teachers. Included in 27 this classification are prekindergarten instructors funded in 28 the Florida Education Finance Program who hold an educator 29 certificate in Prekindergarten/Primar y Education, Preschool 30 Education, Early Childhood Education, or any exceptional student 31 education area with the Prekindergarten Disabilities 32 endorsement. 33 (b) Student personnel services. —Student personnel services 34 include staff members responsible for: ad vising students with 35 regard to their abilities and aptitudes, educational and 36 occupational opportunities, and personal and social adjustments; 37 providing placement services; performing educational 38 evaluations; and similar functions. Included in this 39 classification are certified school counselors, social workers, 40 career specialists, and school psychologists. 41 (c) Librarians/media specialists. —Librarians/media 42 specialists are staff members responsible for providing school 43 library media services. These employe es are responsible for 44 evaluating, selecting, organizing, and managing media and 45 technology resources, equipment, and related systems; 46 facilitating access to information resources beyond the school; 47 working with teachers to make resources available in the 48 instructional programs; assisting teachers and students in media 49 productions; and instructing students in the location and use of 50 HB 1219 2022 CODING: Words stricken are deletions; words underlined are additions. hb1219-00 Page 3 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S information resources. 51 (d) Other instructional staff. —Other instructional staff 52 are staff members who are part of the instru ctional staff but 53 are not classified in one of the categories specified in 54 paragraphs (a)-(c). Included in this classification are primary 55 specialists, learning resource specialists, instructional 56 trainers, adjunct educators certified pursuant to s. 1012.5 7, 57 and similar positions. 58 (e) Education paraprofessionals. —Education 59 paraprofessionals are individuals who are under the direct 60 supervision of an instructional staff member, aiding the 61 instructional process. Included in this classification are 62 classroom paraprofessionals in regular instruction, exceptional 63 education paraprofessionals, career education paraprofessionals, 64 adult education paraprofessionals, library paraprofessionals, 65 physical education and playground paraprofessionals, and other 66 school-level paraprofessionals. 67 Section 2. This act shall take effect July 1, 2022. 68
