2222 Be It Enacted by the Legislature of the State of Florida: 9

2424 Section 1. Section 633.3041, Florida Statutes, is created 11
2525 to read: 12
2626 633.3041 Firefighting foam. — 13
2727 (1) As used in this section, the term: 14
2828 (a) "Class B firefighting foam" means any foam designed to 15
2929 extinguish flammable liquid fires. 16
3030 (b) "PFAS chemicals" means a class of fluorinated organic 17
3131 chemicals containing at least one fully fluorinated carbon atom, 18
3232 including perfluoroalkyl and polyfluoroalkyl substances, 19
3333 designed to be fully functional in Class B firefighting foam 20
3434 formulations. 21
3535 (c) "Testing" means calibration, conformance, or fixed 22
3636 system testing. 23
3737 (2) Beginning January 1, 2023, a fire service provider may 24
3838 not discharge or otherwise use Class B firefighting foam that 25

5151 contains intentionally added PFAS chemicals unless such 26
5252 discharge or use occurs in fire prevention or in response to an 27
5353 emergency firefighting operation. 28
5454 (3) This section does not: 29
5555 (a) Restrict the manufacturing, sale, or distribution of 30
5656 Class B firefighting foam that contains intentionally added PFAS 31
5757 chemicals or restrict the discharge or use of Class B 32
5858 firefighting foam in response to fire prevention or an emergency 33
5959 firefighting operation. 34
6060 (b) Prevent the use of nonfluorinated foams, including 35
6161 other Class B firefighting foams, for purposes of firefighter 36
6262 training or testing. 37
6363 Section 2. This act shall take effect July 1, 2022. 38
