An act relating to discharge and use of firefighting 2 
foam; creating s. 633.3041, F.S.; providing 3 
definitions; prohibiting the use of Class B 4 
firefighting foam beginning on a specified date; 5 
providing an exception; providing construction; 6 
providing an effective date. 7 
 8 
Be It Enacted by the Legislature of the State of Florida: 9 
 10 
 Section 1.  Section 633.3041, Florida Statutes, is created 11 
to read: 12 
 633.3041  Firefighting foam. — 13 
 (1)  As used in this section, the term: 14 
 (a)  "Class B firefighting foam" means any foam designed to 15 
extinguish flammable liquid fires. 16 
 (b)  "PFAS chemicals" means a class of fluorinated organic 17 
chemicals containing at least one fully fluorinated carbon atom, 18 
including perfluoroalkyl and polyfluoroalkyl substances, 19 
designed to be fully functional in Class B firefighting foam 20 
formulations. 21 
 (c)  "Testing" means calibration, conformance, or fixed 22 
system testing. 23 
 (2)  Beginning January 1, 2023, a fire service provider may 24 
not discharge or otherwise use Class B firefighting foam that 25

contains intentionally added PFAS chemicals unless such 26 
discharge or use occurs in fire prevention or in response to an 27 
emergency firefighting operation. 28 
 (3)  This section does not: 29 
 (a)  Restrict the manufacturing, sale, or distribution of 30 
Class B firefighting foam that contains intentionally added PFAS 31 
chemicals or restrict the discharge or use of Class B 32 
firefighting foam in response to fire prevention or an emergency 33 
firefighting operation. 34 
 (b)  Prevent the use of nonfluorinated foams, including 35 
other Class B firefighting foams, for purposes of firefighter 36 
training or testing. 37 
 Section 2.  This act shall take effect July 1, 2022. 38
