2020 Be It Enacted by the Legislature of the State of Florida: 9

2222 Section 1. (1) Notwithstanding s. 561.20(1), Florida 11
2323 Statutes, in the areas herein described as the City of Apopka – 12
2424 Community Redevelopment Agency (CRA) District, the Division of 13
2525 Alcoholic Beverages and Tobacco of the Department of Business 14
2626 and Professional Regulation shall issue a special alcoholic 15
2727 beverage license to a bona fide restaurant in the City of Apopka 16
2828 – CRA District described land in subsection (2) that is licensed 17
2929 by the Division of Hotels and Restaurants of the Department of 18
3030 Business and Professional Regulation, occupies at least 1,800 19
3131 square feet of contiguous space used as a part of the food 20
3232 service establishment, is equipped to serve meals to 80 persons 21
3333 at one time, and derives at least 51 percent of its gross food 22
3434 and beverage revenue from the sale of food and nonalcoholic 23
3535 beverages during the first 60 -day operating period and each 12 -24
3636 month operating period thereafter. Failure of any licensee 25

4747 issued this special license to meet the required percentage of 26
4848 food and nonalcoholic beverage gross revenue during the covered 27
4949 operating period shall result in the revocation of the license 28
5050 or denial of the pending application for a permanent license of 29
5151 a licensee operating with a temporary license. A licensee whose 30
5252 license is revoked, or an applicant whose pending application 31
5353 for a permanent license is denied, or a ny person required to 32
5454 qualify on the special alcoholic beverage license application, 33
5555 is ineligible to have any interest in a subsequent application 34
5656 for such license for a period of 120 days after the date of the 35

5858 (2) For purposes of this act, the City of Apopka – CRA 37
