An act relating to City of Apopka, Orange County; 2 
providing an exception to general law; providing 3 
space, seating, and minimum gross revenue requirements 4 
for special alcoholic beverage licenses for 5 
restaurants in described areas; providing boundaries; 6 
providing an effective date. 7 
 8 
Be It Enacted by the Legislature of the State of Florida: 9 
 10 
 Section 1.  (1)  Notwithstanding s. 561.20(1), Florida 11 
Statutes, in the areas herein described as the City of Apopka – 12 
Community Redevelopment Agency (CRA) District, the Division of 13 
Alcoholic Beverages and Tobacco of the Department of Business 14 
and Professional Regulation shall issue a special alcoholic 15 
beverage license to a bona fide restaurant in the City of Apopka 16 
– CRA District described land in subsection (2) that is licensed 17 
by the Division of Hotels and Restaurants of the Department of 18 
Business and Professional Regulation, occupies at least 1,800 19 
square feet of contiguous space used as a part of the food 20 
service establishment, is equipped to serve meals to 80 persons 21 
at one time, and derives at least 51 percent of its gross food 22 
and beverage revenue from the sale of food and nonalcoholic 23 
beverages during the firs t 60-day operating period and each 12 -24 
month operating period thereafter. Failure of any licensee 25

issued this special license to meet the required percentage of 26 
food and nonalcoholic beverage gross revenue during the covered 27 
operating period shall result in the revocation of the license 28 
or denial of the pending application for a permanent license of 29 
a licensee operating with a temporary license. A licensee whose 30 
license is revoked, or an applicant whose pending application 31 
for a permanent license is denied, or any person required to 32 
qualify on the special alcoholic beverage license application, 33 
is ineligible to have any interest in a subsequent application 34 
for such license for a period of 120 days after the date of the 35 
final denial or revocation. 36 
 (2)  For purposes of this act, the City of Apopka – CRA 37 
District means the area more particularly described as follows: 38

Beginning at the intersection of the Northerly Right -40 
of-Way line of Tenth Street with the Easterly Right -41 
of-Way line of Hawthorne Avenue; Run then ce Northerly 42 
along said Easterly line to the Northerly Right­of -Way 43 
line of Ninth Street; Run thence Westerly at right 44 
angles from the Easterly line of Hawthorne Avenue to 45 
the Westerly Right-of-Way line of Hawthorne Avenue; 46 
Run thence Northerly along said Westerly line to the 47 
Southeast corner of lot 16, Block "B" of Bradshaw and 48 
Thompson's Addition to Apopka as recorded in Plat Book 49
