5656 Section 1. Paragraph (a) of subsection (1) of section 31
5757 1009.40, Florida Statutes, is amended to read: 32
5858 1009.40 General requirements for studen t eligibility for 33
5959 state financial aid awards and tuition assistance grants. — 34
6060 (1)(a) The general requirements for eligibility of 35
6161 students for state financial aid awards and tuition assistance 36
6262 grants consist of the following: 37
6363 1. Achievement of the academ ic requirements of and 38
6464 acceptance at a state university or Florida College System 39
6565 institution; a nursing diploma school approved by the Florida 40
6666 Board of Nursing; a Florida college or university which is 41
6767 accredited by an accrediting agency recognized by the State 42
6868 Board of Education; a Florida institution the credits of which 43
6969 are acceptable for transfer to state universities; a career 44
7070 center; or a private career institution accredited by an 45
7171 accrediting agency recognized by the State Board of Education. 46
7272 2. Residency in this state for no less than 1 year 47
7373 preceding the award of aid or a tuition assistance grant for a 48
7474 program established pursuant to s. 1009.50, s. 1009.505, s. 49

9090 than to obtain an education. Resident status for purposes of 53
9191 receiving state financial aid awards is shall be determined in 54
9292 the same manner as resident status for tuition purposes pursuant 55
9393 to s. 1009.21. However, for purposes of receiving state 56
9494 financial aid awards, a student may not be denied classification 57
9595 as a resident based solely upon his or her immigration status if 58
9696 he or she has been granted: 59
9797 a. Temporary protected status by the United States 60
9898 Department of Homeland Security; or 61
9999 b. Deferred Action for Childhood Arrivals status or 62
100100 another form of prosecutorial discretion by the United States 63
101101 Department of Homeland Security. 64
102102 3. Submission of certificat ion attesting to the accuracy, 65
103103 completeness, and correctness of information provided to 66
104104 demonstrate a student's eligibility to receive state financial 67
105105 aid awards or tuition assistance grants. Falsification of such 68
106106 information shall result in the denial of a pending application 69
107107 and revocation of an award or grant currently held to the extent 70
108108 that no further payments shall be made. Additionally, students 71
109109 who knowingly make false statements in order to receive state 72
110110 financial aid awards or tuition assistance g rants commit a 73
111111 misdemeanor of the second degree subject to the provisions of s. 74
112112 837.06 and shall be required to return all state financial aid 75

126126 Section 2. Section 1009.896, Florida Statutes, is cr eated 77

128128 1009.896 Professional Student Loan Repayment Program. — 79
129129 (1) As used in this section, the term: 80
130130 (a) "Professional" means an individual who meets any of 81
131131 the criteria of subsection (3). 82
132132 (b) "Shortage area" or "shortage" means a geographic area 83
133133 designated by the Department of Education which is experiencing 84
134134 a vacancy rate of more than 20 percent in the positions 85
135135 described in subsection (3). 86
136136 (2) The Professional Student Loan Repayment Program is 87
137137 established within the Department of Education to encourage 88
138138 professionals to practice in locations experiencing a shortage 89
139139 of such professionals. As an incentive, the program will make 90
140140 payments to repay the student loans of eligible professionals. 91
141141 (3) The following professionals are elig ible to 92
142142 participate in this program: 93
143143 (a) Veterinarians licensed under chapter 474. 94
144144 (b) Physicians licensed under chapter 458 or chapter 459. 95
145145 (c) Licensed practical nurses, registered nurses, and 96
146146 advanced practice registered nurses licensed under part I of 97
147147 chapter 464. 98
148148 (d) Dentists licensed under chapter 466. 99
149149 (e) Instructional personnel certified under chapter 1012. 100

162162 (4)(a) Subject to appropriation and on a first -come, 101
163163 first-served basis, the department shall make payments to 102
164164 professionals to repa y student loans that were used by 103
165165 professionals to pay the costs of tuition, books, living 104
166166 expenses, and applicable equipment, supplies, and uniforms as 105
167167 determined by the department on a profession -by-profession 106
168168 basis. 107
169169 (b) All repayments are contingent on proof of primary 108
170170 employment as defined in State Board of Education rule in a 109
171171 profession described in subsection (3) in a shortage area. The 110
172172 state bears no responsibility for the accrual of any interest 111
173173 charges or other remaining balances. 112
174174 (c) The department shall determine repayment amounts on a 113
175175 profession-by-profession basis, except that repayments may not 114
176176 exceed $50,000 per year per eligible professional. 115
177177 (d) A professional may receive repayments under the 116
178178 program for a maximum of 5 years. 117
179179 (5) A repayment may not be made to a professional 118
180180 receiving student loan repayments or forgiveness under s. 119
181181 381.4019 or any other student loan repayment or forgiveness 120
182182 program pursuant to this chapter. 121
183183 (6) The state board shall adopt rules to administer this 122
184184 section. 123
185185 Section 3. This act shall take effect July 1, 2022. 124
