2121 Be It Enacted by the Legislature of the State of Florida: 8

2323 Section 1. Subsection (2) of section 843.22, Florida 10
2424 Statutes, is amended to read: 11
2525 843.22 Traveling across county lines with intent to commit 12
2626 a burglary.— 13
2727 (2) If a person who commits a burglary travels any 14
2828 distance with the intent to commit the burglary in a county in 15
2929 this state other than the person's county of residence, the 16
3030 degree of the burglar y shall be reclassified to the next higher 17
3131 degree if the purpose of the person's travel is to thwart law 18
3232 enforcement attempts to track the items stolen in the burglary . 19
3333 For purposes of sentencing under chapter 921 and determining 20
3434 incentive gain-time eligibility under chapter 944, a burglary 21
3535 that is reclassified under this section is ranked one level 22
3636 above the ranking specified in s. 921.0022 or s. 921.0023 for 23
3737 the burglary committed. 24
3838 Section 2. This act shall take effect October 1, 2022. 25
