2323 Be It Enacted by the Legislature of the State o f Florida: 10

2525 Section 1. Subsection (8) of section 382.008, Florida 12
2626 Statutes, is amended to read: 13
2727 382.008 Death, fetal death, and nonviable birth 14
2828 registration.— 15
2929 (8)(a) The original nonviable birth certificate shall 16
3030 contain all of the information requ ired by the department for 17
3131 legal, social, and health research purposes. The department may 18
3232 issue a certified copy of an original nonviable birth 19
3333 certificate which includes the confidential and exempt 20
3434 information: 21
3535 1. To the fetus' parent; 22
3636 2. To any local, state, or federal agency for official 23
3737 purposes upon approval by the department; or 24
3838 3. Upon the order of any court of competent jurisdiction. 25

5151 (b) All information relating to the cause of death and 26
5252 parentage of a nonviable fetus, the marital status of such 27
5353 fetus' parent, and any medical information included in nonviable 28
5454 birth records held by a state agency is confidential and exempt 29
5555 from s. 119.07(1) and s. 24(a), Art. I of the State 30
5656 Constitution, but may be released for health research purposes 31
5757 as approved by the department. 32
5858 (c)1. The department shall authorize the issuance of a 33
5959 certified copy of all or part of an original nonviable birth 34
6060 certificate, excluding any information that is confidential and 35
6161 exempt from s. 119.07(1) and s. 24(a), Art. I of the State 36
6262 Constitution, to any person requesting such copy, pursuant to 37
6363 paragraph (b), upon receipt of a request and payment of the fee 38
6464 prescribed in s. 382.0255. 39
6565 2. The department may issue a certified copy of an 40
6666 original nonviable birth certificate wh ich includes the 41
6767 confidential and exempt information: 42
6868 a. To the fetus' parent; 43
6969 b. To any local, state, or federal agency for official 44
7070 purposes upon approval by the department; or 45
7171 c. Upon the order of any court of competent jurisdiction. 46
7272 (d) This subsection is subject to the Open Government 47
7373 Review Act in accordance with s. 119.15, and shall stand 48
7474 repealed on October 2, 2022, unless reviewed and saved from 49
7575 repeal through reenactment by the Legislature. 50
