3030 Be It Enacted by the Legislature of the State of Florida: 17

3232 Section 1. Subsection (8) is added to section 11.90, 19

3434 11.90 Legislative Budget Commission. — 21
3535 (8) The commission may convene to tr ansfer or appropriate 22

5252 252.37 Financing.— 27
5353 (2)(a) It is the legislative intent that the first 28
5454 recourse be made to funds specifically regularly appropriated to 29
5555 state and local agencies for disaster relief or response . 30
5656 (b) If the Governor finds that the demands placed upon 31
5757 these funds in coping with a particular disas ter declared by the 32
5858 Governor as a state of emergency are unreasonably great, she or 33
5959 he may make funds available by transferring and expending moneys 34
6060 appropriated for other purposes, by transferring and expending 35
6161 moneys out of any unappropriated surplus fun ds, or from the 36
6262 Emergency Preparedness and Response Budget Stabilization Fund 37
6363 created under s. 252.3711. The Governor may request that 38
6464 additional funds be transferred or appropriated to the Emergency 39
6565 Preparedness and Response Fund by a budget amendment, su bject to 40
6666 approval of the Legislative Budget Commission . 41
6767 (c) Following the expiration or termination of the state 42
6868 of emergency, the Governor may transfer moneys with a budget 43
6969 amendment, subject to approval by the Legislative Budget 44
7070 Commission, to satisfy the budget authority granted for such 45
7171 emergency. The transfers and expenditures supporting the 46
7272 amendment must be directly related to the declared disaster or 47
7373 emergency. 48
7474 Section 3. The Chief Financial Officer shall immediately 49

8888 Revenue Fund to the Emergency Preparedness and Response Fund in 51

9292 Section 4. This act shall take effect on the same date 55
9393 that HB 7023 or similar legislation takes effect , if such 56
9494 legislation is adopted in the same legislative session or an 57
9595 extension thereof and becomes a law. 58
