Sunset Review Act; amending s. 626.9891, F.S., which 3
provides an exemption from public records requirements 4
for certain information submitted by insurers to the 5
Department of Financial Services; removing the 6
scheduled repeal of the exemption; providing an 7
effective date. 8

Be It Enacted by the Legislature of the State of Florida: 10

Section 1. Subsection ( 11) of section 626.9891, Florida 12
Statutes, is amended to read: 13
626.9891 Insurer anti -fraud investigative units; reporting 14
requirements; penalties for noncompliance. — 15
(11)(a) The information submitted to the department 16
pursuant to paragraphs (3)(d), (e) , and (f) and paragraphs 17
(5)(d), (e), (f), (g), and (k) is exempt from s. 119.07(1) and 18
s. 24(a), Art. I of the State Constitution. 19
(b) This subsection is subject to the Open Government 20
Sunset Review Act in accordance with s. 119.15 and shall stand 21
repealed on October 2, 2022, unless reviewed and saved from 22
repeal through reenactment by the Legislature. 23
(b)(c) This exemption applies to records held before, on, 24
or after the effective date of this act. 25

Section 2. This act shall take effect October 1, 2022. 26
