HB 7063 2022 CODING: Words stricken are deletions; words underlined are additions. hb7063-00 Page 1 of 8 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to identification cards; amending s. 2 322.051, F.S.; requiring the Department of Highway 3 Safety and Motor Vehicles to issue or renew 4 identification cards at no charge to persons 5 presenting a valid voter's registration card and 6 attesting to financial hardship; prohibiting the 7 department from requiring such persons to present 8 certain evidence; requiring the department to issue 9 identification cards at no charge to certain other 10 persons; conforming cross -references; amending ss. 11 322.18 and 322.21, F.S.; conforming provisions to 12 changes made by the act; providing an effective date. 13 14 Be It Enacted by the Legislature of the State of Florida : 15 16 Section 1. Paragraphs (b), (c), and (d) of subsection (8) 17 and subsection (9) of section 322.051, Florida Statutes, are 18 amended, and subsection (10) is added to that section, to read: 19 322.051 Identification cards. — 20 (8) 21 (b)1. The word "Veteran" m ust be exhibited on the 22 identification card of a veteran upon the presentation of a copy 23 of the person's: 24 a. Veteran health identification card, issued by the 27 United States Department o f Veterans Affairs; 28 c. Veteran identification card, issued by the United 29 States Department of Veterans Affairs pursuant to the Veterans 30 Identification Card Act of 2015, Pub. L. No. 114 -31; or 31 d. Other acceptable form specified by the Department of 32 Veterans' Affairs. 33 2. Until a veteran's identification card is next renewed, 34 the veteran may have the word "Veteran" added to his or her 35 identification card upon surrender of his or her current 36 identification card and presentation of any of the forms of 37 identification specified in subparagraph 1. If the applicant is 38 not conducting any other transaction affecting the 39 identification card, a replacement identification card must be 40 issued with the word "Veteran" without payment of the fee 41 required in s. 322.21(1)(f)3.c. s. 322.21(1)(f)3. 42 (c) The international symbol for the deaf and hard of 43 hearing shall be exhibited on the identification card of a 44 person who is deaf or hard of hearing upon the payment of an 45 additional $1 fee for the identification card and the 46 presentation of sufficient proof that the person is deaf or hard 47 of hearing as determined by the department. Until a person's 48 identification card is next renewed, the person may have the 49 symbol added to his or her identification card upon surrender of 50 HB 7063 2022 CODING: Words stricken are deletions; words underlined are additions. hb7063-00 Page 3 of 8 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S his or her current identification card, payment of a $2 fee to 51 be deposited into the Highway Safety Operating Trust Fund, and 52 presentation of sufficient proof that the person is deaf or hard 53 of hearing as determined by the department. If the applicant is 54 not conducting any other transaction affecting the 55 identification card, a replacement identification card may be 56 issued with the symbol without payment of the fee required in s. 57 322.21(1)(f)3.c. s. 322.21(1)(f)3. For purposes of this 58 paragraph, the internationa l symbol for the deaf and hard of 59 hearing is substantially as follows: 60 61 62 63 (d) The department shall include symbols representing the 64 following on an identification card upon the payment of an 65 additional $1 fee by an applicant who meets the requirements of 66 subsection (1) and presents his or her: 67 1. Lifetime freshwater fishing license; 68 2. Lifetime saltwater fishing license; 69 3. Lifetime hunting license; 70 4. Lifetime sportsman's license; or 71 5. Lifetime boater safety identification card. 72 HB 7063 2022 CODING: Words stricken are deletions; words underlined are additions. hb7063-00 Page 4 of 8 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S 73 A person may replace his or her identification card before its 74 expiration date with a card that includes his or her status as a 75 lifetime licensee or boater safety cardholder upon surrender of 76 his or her current identification card, payment of a $2 fee to 77 be deposited into the Highway Safety Operating Trust Fund, and 78 presentation of the person's lifetime license or card. If the 79 sole purpose of the replacement identification card is the 80 inclusion of the applicant's status as a lifetime licensee or 81 cardholder, the replac ement identification card must be issued 82 without payment of the fee required in s. 322.21(1)(f)3.c. s. 83 322.21(1)(f)3. 84 (9)(a) Notwithstanding any other provision of this section 85 or s. 322.21 to the contrary, the department shall issue or 86 renew a card at no charge to: 87 1. A person who presents a valid Florida voter's 88 registration card to the department and attests that he or she 89 is experiencing a financial hardship. The department may not 90 require such person to present evidence of a financial hardship. 91 2. A person who presents evidence satisfactory to the 92 department that he or she is homeless as defined in s. 93 414.0252(7). 94 3., to A juvenile offender who is in the custody or under 95 the supervision of the Department of Juvenile Justice and 96 receiving services pursuant to s. 985.461 . 97 HB 7063 2022 CODING: Words stricken are deletions; words underlined are additions. hb7063-00 Page 5 of 8 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S 4., to An inmate receiving a card issued pursuant to s. 98 944.605(7), or, if necessary, to an inmate receiving a 99 replacement card if the department determines that he or she has 100 a valid state identification card. If the replacemen t state 101 identification card is scheduled to expire within 6 months, the 102 department may also issue a temporary permit valid for at least 103 6 months after the release date. 104 (b) The department's mobile issuing units shall process 105 the identification cards for juvenile offenders and inmates at 106 no charge, as provided by s. 944.605 (7)(a) and (b). 107 (10) Notwithstanding any other provision of this section 108 or s. 322.21 to the contrary, the department shall issue an 109 identification card at no charge to a person who i s 80 years of 110 age or older and whose driving privilege is denied due to 111 failure to pass a vision test administered pursuant to s. 112 322.18(5). 113 Section 2. Paragraph (c) is added to subsection (5) of 114 section 322.18, Florida Statutes, to read: 115 322.18 Original applications, licenses, and renewals; 116 expiration of licenses; delinquent licenses. — 117 (5) All renewal driver licenses may be issued after the 118 applicant licensee has been determined to be eligible by the 119 department. 120 (c) The department shall issue an identification card 121 under s. 322.051 at no charge to a licensee who is at least 80 122 HB 7063 2022 CODING: Words stricken are deletions; words underlined are additions. hb7063-00 Page 6 of 8 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S years of age and whose driving privilege is denied due to 123 failure to pass a vision test pursuant to this subsection. 124 Section 3. Paragraph (f) of subsection (1) of sectio n 125 322.21, Florida Statutes, is amended to read: 126 322.21 License fees; procedure for handling and collecting 127 fees.— 128 (1) Except as otherwise provided herein, the fee for: 129 (f) An original, renewal, or replacement identification 130 card issued pursuant to s. 322.051 is $25. 131 1., except that An applicant who meets any of the 132 following criteria is exempt from the fee under this paragraph 133 for an original, renewal, or replacement identification card: 134 a. The applicant presents a valid Florida voter's 135 registration card to the department and attests that he or she 136 is experiencing a financial hardship. 137 b. The applicant presents evidence satisfactory to the 138 department that he or she is homeless as defined in s. 139 414.0252(7). 140 c. The applicant presents evidence sat isfactory to the 141 department that; his or her annual income is at or below 100 142 percent of the federal poverty level . 143 d. The applicant; or he or she is a juvenile offender who 144 is in the custody or under the supervision of the Department of 145 Juvenile Justice, who is receiving services pursuant to s. 146 985.461, and whose identification card is issued by the 147 HB 7063 2022 CODING: Words stricken are deletions; words underlined are additions. hb7063-00 Page 7 of 8 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S department's mobile issuing units is exempt from such fee . 148 2. Pursuant to s. 322.051(10), an applicant who is 80 149 years of age or older and whose driving pr ivilege is denied due 150 to failure to pass a vision test administered pursuant to s. 151 322.18(5) is exempt from the fee under this paragraph for an 152 original identification card. 153 3. Funds collected from fees for original, renewal, or 154 replacement identification cards shall be distributed as 155 follows: 156 a.1. For an original identification card issued pursuant 157 to s. 322.051, the fee shall be deposited into the General 158 Revenue Fund. 159 b.2. For a renewal identification card issued pursuant to 160 s. 322.051, $6 shall be deposited into the Highway Safety 161 Operating Trust Fund, and $19 shall be deposited into the 162 General Revenue Fund. 163 c.3. For a replacement identification card issued pursuant 164 to s. 322.051, $9 shall be deposited into the Highway Safety 165 Operating Trust Fund, and $16 shall be deposited into the 166 General Revenue Fund. Beginning July 1, 2015, or upon completion 167 of the transition of the driver license issuance services, if 168 the replacement identification card is issued by the tax 169 collector, the tax collector shall retain the $9 that would 170 otherwise be deposited into the Highway Safety Operating Trust 171 Fund and the remaining revenues shall be deposited into the 172 HB 7063 2022 CODING: Words stricken are deletions; words underlined are additions. hb7063-00 Page 8 of 8 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S General Revenue Fund. 173 Section 4. This act shall take effect July 1, 2022. 174
