A bill to be entitled 1 
An act relating to emergency opioid antagonists; 2 
creating s. 1004.0971, F.S.; providing definitions; 3 
requiring each Florida College System institution and 4 
state university to have a supply of emergency opioid 5 
antagonists in certain residence halls or dormitory 6 
residences for use by specified resident assistants 7 
and employees; providing requirements for the 8 
placement and accessibility of emergency opioid 9 
antagonists; providing training requirements; 10 
encouraging public and private partnerships to cover 11 
the costs of emergency opioid antagonists; providing 12 
specified resident assistants and employees and 13 
Florida College System institutions and state 14 
universities immunity from liability for the 15 
administration or attempted administration of 16 
emergency opioid antagonists under certain 17 
circumstances; requiring the State Board of Education 18 
and the Board of Governors, in cooperation with the 19 
Department Health, to adopt ru les and regulations, 20 
respectively; providing an effective date. 21

Be It Enacted by the Legislature of the State of Florida: 23 
 24 
 Section 1.  Section 1004.0971, Florida Statutes, is created 25

 1004.0971  Emergency opioid antagonists in Florida Coll ege 27 
System institution and state university housing. — 28 
 (1)  As used in this section, the term: 29 
 (a)  "Administer" or "administration" means to introduce an 30 
emergency opioid antagonist into the body of a person. 31 
 (b)  "Emergency opioid antagonist" means nal oxone 32 
hydrochloride or any similarly acting drug that blocks the 33 
effects of opioids administered from outside the body and that 34 
is approved by the United States Food and Drug Administration 35 
for the treatment of an opioid overdose. 36 
 (c)  "Institution" means a Florida College System 37 
institution or state university. 38 
 (2)  Each institution must have a supply of emergency 39 
opioid antagonists with an autoinjection delivery system or 40 
intranasal application delivery system in each residence hall or 41 
dormitory residence owned or operated by the institution for the 42 
administration of emergency opioid antagonists to a person 43 
believed to be experiencing an opioid overdose. 44 
 (3)  Each institution must: 45 
 (a)  Place the emergency opioid antagonist in a clearly 46 
marked location within each residence hall or dormitory 47 
residence. The emergency opioid antagonist must be easily 48 
assessible to resident assistants of the residence hall or 49 
dormitory residence or other institution employees who are 50

trained in the administration of emerge ncy opioid antagonists. 51 
 (b)  Provide training in the administration of emergency 52 
opioid antagonists to at least one resident assistant or other 53 
institution employee for each residence hall or dormitory 54 
residence. 55 
 (4)  Public and private partnerships are encouraged to 56 
cover the cost associated with the purchase and placement of the 57 
emergency opioid antagonists. 58 
 (5)  Notwithstanding any other provision of law to the 59 
contrary, any resident assistant or other institution employee 60 
who is trained pursuant to p aragraph (3)(b) who administers or 61 
attempts to administer an emergency opioid antagonist to a 62 
person believed to be experiencing an opioid overdose is immune 63 
from any civil or criminal liability, and the institution is 64 
immune from any civil or criminal lia bility, as a result of such 65 
resident assistant or employee administering or attempting to 66 
administer the emergency opioid antagonist. 67 
 (6)  The State Board of Education and the Board of 68 
Governors, in cooperation with the Department of Health, shall 69 
adopt rules and regulations, respectively, to administer this 70 
section. 71 
 Section 2.  This act shall take effect July 1, 2023. 72
