CS/HB 39 2023 CODING: Words stricken are deletions; words underlined are additions. hb0039-01-c1 Page 1 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S A bill to be entitled 1 An act relating to emergency opioid antagonists; 2 creating s. 1004.0971, F.S.; providing definitions; 3 requiring each Florida College System institution and 4 state university to have a supply of emergency opioid 5 antagonists in certain residence halls or dormitory 6 residences; providing requirements for the placement 7 and accessibility of emergency opioid antagonists for 8 certain campus law enforcement officers; en couraging 9 public and private partnerships to cover the costs of 10 such emergency opioid antagonists; providing immunity 11 from liability for certain campus law enforcement 12 officers and Florida College System institutions and 13 state universities for the administ ration or attempted 14 administration of emergency opioid antagonists under 15 certain circumstances; requiring the State Board of 16 Education and the Board of Governors to adopt rules 17 and regulations, respectively, in cooperation with the 18 Department of Health; pr oviding an effective date. 19 20 Be It Enacted by the Legislature of the State of Florida: 21 22 Section 1. Section 1004.0971, Florida Statutes, is created 23 to read: 24 1004.0971 Emergency opioid antagonists in Florida College 25 CS/HB 39 2023 CODING: Words stricken are deletions; words underlined are additions. hb0039-01-c1 Page 2 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S System institution and state univ ersity housing.— 26 (1) As used in this section, the term: 27 (a) "Administer" or "administration" means to introduce an 28 emergency opioid antagonist into the body of a person. 29 (b) "Emergency opioid antagonist" means naloxone 30 hydrochloride or any similarly acting drug that blocks the 31 effects of opioids administered from outside the body and that 32 is approved by the United States Food and Drug Administration 33 for the treatment of an opioid overdose. 34 (c) "Institution" means a Florida College System 35 institution or state university. 36 (2) Each institution must have a supply of emergency 37 opioid antagonists with an autoinjection or intranasal 38 application delivery system in each residence hall or dormitory 39 residence owned or operated by the institution for the 40 administration of emergency opioid antagonists to a person 41 believed to be experiencing an opioid overdose. 42 (3) Each institution must place the emergency opioid 43 antagonist in a clearly marked location within each residence 44 hall or dormitory residence. The emer gency opioid antagonist 45 must be easily accessible to campus law enforcement officers who 46 are trained in the administration of emergency opioid 47 antagonists. 48 (4) Public and private partnerships are encouraged to 49 cover the costs associated with the purchase and placement of 50 CS/HB 39 2023 CODING: Words stricken are deletions; words underlined are additions. hb0039-01-c1 Page 3 of 3 F L O R I D A H O U S E O F R E P R E S E N T A T I V E S such emergency opioid antagonists. 51 (5) Notwithstanding any other provision of law to the 52 contrary, any campus law enforcement officer trained in the 53 administration of emergency opioid antagonists who administers 54 or attempts to administe r an emergency opioid antagonist in 55 compliance with ss. 381.887 and 768.13, and the institution that 56 employs such officer, are immune from civil or criminal 57 liability as a result of such administration or attempted 58 administration of an emergency opioid ant agonist. 59 (6) The State Board of Education and the Board of 60 Governors shall adopt rules and regulations, respectively, to 61 administer this section in cooperation with the Department of 62 Health. 63 Section 2. This act shall take effect July 1, 2023. 64
