2020 That the following amendment to Section 1 of Article VIII 9
2121 of the State Constitution is agreed to and shall be submitted to 10
2222 the electors of this state for approval or rejection at the next 11
2323 general election or at an earlier special election specifically 12
2424 authorized by law for that purpose: 13

2727 SECTION 1. Counties. — 16
2828 (a) POLITICAL SUBDIVISIONS. The state shall be divided by 17
2929 law into political subdivisions called counties. Counties may be 18
3030 created, abolished or changed by law, with provision for payment 19
3131 or apportionment of the public debt. 20
3232 (b) COUNTY FUNDS. The care, custody and method of 21
3333 disbursing county funds shall be provided by general law. 22
3434 (c) GOVERNMENT. Pursuant to general or special law, a 23
3535 county government may be established by charter which shall be 24
3636 adopted, amended or repealed only upon vote of the electors of 25

4747 the county in a special election called for tha t purpose. 26
4848 (d) COUNTY OFFICERS. There shall be elected by the 27
4949 electors of each county, for terms of four years, a sheriff, a 28
5050 tax collector, a property appraiser, a supervisor of elections, 29
5151 and a clerk of the circuit court. Unless otherwise provided by 30
5252 special law approved by vote of the electors or pursuant to 31
5353 Article V, section 16, the clerk of the circuit court shall be 32
5454 ex officio clerk of the board of county commissioners, auditor, 33
5555 recorder and custodian of all county funds. Notwithstanding 34
5656 subsection 6(e) of this article, a county charter may not 35
5757 abolish the office of a sheriff, a tax collector, a property 36
5858 appraiser, a supervisor of elections, or a clerk of the circuit 37
5959 court; transfer the duties of those officers to another officer 38
6060 or office; change the length of the four -year term of office; or 39
6161 establish any manner of selection other than by election by the 40
6262 electors of the county. 41
6363 (e) COMMISSIONERS. Except when otherwise provided by 42
6464 county charter, the governing body of each county shall be a 43
6565 board of county commissioners composed of five or seven members 44
6666 serving staggered terms of four years. After each decennial 45
6767 census the board of county commissioners shall divide the county 46
6868 into districts of contiguous territory as nearly equal in 47
6969 population as practicable. One commissioner residing in each 48
7070 district shall be elected as provided by law. 49

8282 county charters shall have such power of self -government as is 51
8383 provided by general or special law. The board of county 52
8484 commissioners of a county not operating under a charter may 53
8585 enact, in a manner prescribed by general law, county ordinances 54
8686 not inconsistent with general or special law, but an ordinance 55
8787 in conflict with a municipal ordinance shall not be e ffective 56
8888 within the municipality to the extent of such conflict. 57
8989 (g) CHARTER GOVERNMENT. Counties operating under county 58
9090 charters shall have all powers of local self -government not 59
9191 inconsistent with general law, or with special law approved by 60
9292 vote of the electors. The governing body of a county operating 61
9393 under a charter may enact county ordinances not inconsistent 62
9494 with general law. The charter shall provide which shall prevail 63
9595 in the event of conflict between county and municipal 64
9696 ordinances. 65
9797 (h) TAXES; LIMITATION. Property situate within 66
9898 municipalities shall not be subject to taxation for services 67
9999 rendered by the county exclusively for the benefit of the 68
100100 property or residents in unincorporated areas. 69
101101 (i) COUNTY ORDINANCES. Each county ordinance shall be 70
102102 filed with the custodian of state records and shall become 71
103103 effective at such time thereafter as is provided by general law. 72
104104 (j) VIOLATION OF ORDINANCES. Persons violating county 73
105105 ordinances shall be prosecuted and punished as provided by law. 74

117117 seat at which shall be located the principal offices and 76
118118 permanent records of all county officers. The county seat may 77
119119 not be moved except as provided by general law. Branch offices 78
120120 for the conduct of county business may be established elsewhere 79
121121 in the county by resolution of the governing body of the county 80
122122 in the manner prescribed by law. No instrument shall be deemed 81
123123 recorded until filed at the county seat, or a branch office 82
124124 designated by the governing body of the county for the recording 83
125125 of instruments, according to law. 84
126126 (l) RECALL OF COUNTY OFFICERS AND COMMISSIONERS. The 85
127127 legislature may provide by general law for the recall of county 86
128128 officers and commissioners. 87
