19	19		before it permanently expires; deleting a process by 6
20	20		which a certificateholder may voluntarily place his or 7
21	21		her certificate in inactive status; providing 8
22	22		applicability; prohibiting the Department of He alth 9
23	23		from requiring certificateholders to pay a fee or to 10
24	24		make an election to place their certificates in 11
25	25		inactive status, beginning on a specified date; 12
26	26		requiring that certain fees paid by a 13
27	27		certificateholder before a specified date be credited 14
28	28		toward any future renewal fees required to be paid by 15
29	29		the certificateholder; providing for retroactive 16
30	30		application; providing an effective date. 17

32	32		Be It Enacted by the Legislature of the State of Florida: 19

34	34		Section 1. Paragraphs (f) and (h) of subsection (2) o f 21
35	35		section 401.465, Florida Statutes, are amended to read: 22
36	36		401.465 911 public safety telecommunicator certification. — 23
37	37		(2) PERSONNEL; STANDARDS AND CERTIFICATION. — 24
38	38		(f) A 911 public safety telecommunicator certificate 25

51	51		expires automatically if not renewe d at the end of the 2 -year 26
52	52		period and may be renewed if the holder meets the qualifications 27
53	53		for renewal as established by the department. A certificate that 28
54	54		is not renewed at the end of the 2 -year period automatically 29
55	55		reverts to an inactive status for a pe riod that may not exceed 6 30
56	56		years 180 days. Such certificate may be reactivated and renewed 31
57	57		within the 6-year 180-day period by if the certificateholder 32
58	58		pursuant to paragraph (h). A certificate that has been inactive 33
59	59		for more than 6 years automatically expi res and may not be 34
60	60		renewed meets all other qualifications for renewal and pays a 35
61	61		$50 late fee. Reactivation shall be in a manner and on forms 36
62	62		prescribed by department rule . 37
63	63		(h) A certificateholder may request that his or her 911 38
64	64		public safety telecommuni cator certificate be placed on inactive 39
65	65		status by applying to the department before his or her current 40
66	66		certification expires and paying a fee set by the department, 41
67	67		which may not exceed $50. 42
68	68		(h)1. A certificateholder whose certificate has been on 43
69	69		inactive status for 6 years 1 year or less may renew his or her 44
70	70		certificate pursuant to the rules adopted by the department and 45
71	71		upon payment of a renewal fee set by the department, which may 46
72	72		not exceed $50. 47
73	73		2. A certificateholder whose certificate has been on 48
74	74		inactive status for more than 1 year may renew his or her 49
75	75		certificate pursuant to rules adopted by the department. 50

88	88		3. A certificate that has been inactive for more than 6 51
89	89		years automatically expires and may not be renewed. 52
90	90		Section 2. (1) The amendments made by this act to s. 53
91	91		401.465(2)(f) and (h), Florida Statutes, apply regardless of 54
92	92		whether the certificateholder voluntarily placed his or her 55
93	93		certificate in inactive status pursuant to former s. 56
94	94		401.465(2)(h), Florida Statutes, or the certificate reve rted to 57
95	95		inactive status pursuant to s. 401.465(2)(f), Florida Statutes, 58
96	96		during the 6-year period before the effective date of this act. 59
97	97		Beginning on the effective date of this act, the Department of 60
98	98		Health may not require a certificateholder to pay a fee o r to 61
99	99		make an election to place his or her certificate in inactive 62
100	100		status. 63
101	101		(2) Any fee paid by a certificateholder to voluntarily 64
102	102		place his or her certificate in inactive status during the 6 -65
103	103		year period before the effective date of this act must be 66
104	104		credited toward any future renewal fee required to be paid by 67
105	105		the certificateholder under s. 401.465(2)(h), Florida Statutes. 68
106	106		(3) This act is remedial in nature and applies 69
107	107		retroactively to any public safety telecommunicator certificate 70
108	108		that has expired pursua nt to former s. 401.465(2)(f), Florida 71
109	109		Statutes, during the 6 -year period before the effective date of 72
110	110		this act. 73
111	111		Section 3. This act shall take effect upon becoming a law. 74
