21+authorizing the office to petition certain courts for 8
22+specified purposes; providing an effective date. 9

24- Section 1. Subsection (5) of section 20.15 5, Florida 11
25-Statutes, is amended to read: 12
26- 20.155 Board of Governors of the State University System. — 13
27- (5) OFFICE OF INSPECTOR GENERAL. —An Office of Inspector 14
28-General shall be organized using existing resources and funds to 15
29-promote accountability, efficie ncy, and effectiveness and to 16
30-detect fraud and abuse within state universities. 17
31- (a) If the Board of Governors determines that a state 18
32-university board of trustees is unwilling or unable to address 19
33-substantiated allegations made by any person relating to waste, 20
34-fraud, or financial mismanagement, the office must shall 21
35-conduct, coordinate, or request investigations into 22
36-substantiated allegations made by any person relating to waste, 23
37-fraud, or financial mismanagement within a state university. The 24
38-office shall have access to all information and personnel 25

51-necessary to perform its duties and shall have all of its 26
52-current powers, duties, and responsibilities authorized in s. 27
53-20.055. 28
54- (b) In exercising authority under this section, the office 29
55-may do any of the fo llowing: 30
56- 1. Issue and serve subpoenas and subpoenas duces tecum, 31
57-for the Board of Governors or universities under the 32
58-jurisdiction of the State University System, to compel the 33
59-appearance of witnesses and the production of documents, 34
60-reports, answers, re cords, accounts, and other data in any 35
61-medium. 36
62- 2. Require or authorize a person to file a written 37
63-statement, under oath if required, as to all the facts and 38
51+within a state university. The office shall have access to all 26
52+information and personnel necessary to perform its duties and 27
53+shall have all of its current powers, duties, and 28
54+responsibilities authoriz ed in s. 20.055. 29
55+ (b)1. In exercising authority under this subsection, the 30
56+Office of Inspector General or his or her designee may: 31
57+ a. Issue and serve subpoenas duces tecum for the Board of 32
58+Governors or the state universities in the State University 33
59+System to compel the attendance of witnesses and the production 34
60+of documents, reports, answers, records, accounts, and other 35
61+data in any medium. 36
62+ b. Require or allow a person to file a statement in 37
63+writing, under oath or otherwise, as to all the facts and 38
6464 circumstances concerning the matter to be audited, examined, or 39
6565 investigated. 40
66- (c) In the event of noncompliance with a subpoena issued 41
67-under paragraph (b), the office may petition the circuit court 42
68-of the county in which the person subpoenaed resides or has his 43
69-or her principal place of business for an order requiring the 44
70-subpoenaed person to appear and testify and to produce 45
71-documents, reports, answers, records, accounts, or other data as 46
72-specified in the subpoena. 47
66+ 2. In the event of noncompliance with a subpoena issued 41
67+under this paragraph, the Inspector General may petition the 42
68+circuit court of the county in which the person subpoenaed 43
69+resides or has his or her principal place of business for an 44
70+order requiring the subpoenaed person to appear and testify and 45
71+to produce documents, reports, answers, records, accounts, or 46
72+other data as specified in the subpoena. 47
7373 Section 2. This act shall t ake effect July 1, 2023. 48
