2020 Be It Enacted by the Legislature of the State of Florida: 7

2222 Section 1. Subsection (1) of section 817.802, Florida 9
2323 Statutes, is amended to read: 10
2424 817.802 Unlawful fees and costs. — 11
2525 (1) It is unlawful for any person, while engaging in debt 12
2626 management services or credit counseling services, to charge or 13
2727 accept from a debtor residing in this state, directly or 14
2828 indirectly, a fee or contribution greater than $50 for the 15
2929 initial setup or initial consultation. Subsequently, the person 16
3030 may not charge or accept a fee or contribution from a debtor 17
3131 residing in this state greater than $120 per year for additional 18
3232 consultations or, alternatively, if debt management services as 19
3333 defined in s. 817.801(4)(b) are provided, the person may charge 20
3434 up to the lesser greater of 15 7.5 percent of the amount paid 21
3535 monthly by the debtor to the person or $75 $35 per month. 22
3636 Section 2. This act shall take effect July 1, 2023. 23
